In order to comply with the laws of New York State, Nassau County, Town of Oyster Bay and the City of Glen Cove, and in order to ensure the health, safety and general welfare of the residents of the Incorporated Village of Centre Island and its employees, the following regulations are necessary and become effective upon filing with the Secretary of State, New York State.
As used in this Article, the following terms shall have the meanings indicated:
ASHES
Include the residue from burning wood, coal, coke or other combustible materials.
GARBAGE
Includes wastes from preparation and cooking of food, combustible containers, magazines and small household items which are capable of combustion, fermentation or decay. This shall not include any recyclable items, hazardous materials or rubbish.
HAZARDOUS MATERIALS
Include solid or liquid waste whose combustion at an incinerator would cause danger from residue ash, waste gases or explosions. These are generally defined by the Town of Oyster Bay S.T.O.P. Program and City of Glen Cove incinerator and shall include but not be limited to chemicals, cleaners, paints, oils, automobile tires and batteries and aerosol cans. In addition, they shall include explosives, fireworks, radioactive materials, infectious materials, propane tanks, etc.
RECYCLABLES
Include:
A. 
GLASSClear (flint), amber and green glass food and beverage containers, rinsed clean of food residue.
B. 
FERROUS AND BIMETAL CANSFood and beverage containers, one end removed, rinsed clean of food residue.
C. 
ALUMINUM CANSFood and beverage containers, rinsed clean of food residue.
D. 
PLASTICSFood and beverage containers and other nonhazardous household commodities, rinsed clean of residue.
E. 
NEWSPRINTAll newspapers and advertisements, supplements, comics and enclosures, but exclusive of magazines.
REFUSE
A general term, which includes ashes, garbage, recyclables and rubbish.
RUBBISH
Includes any and all materials of a generally combustible nature not included under the terms "ashes" and "garbage," including but not limited to such items as rugs, furniture, ranges, refrigerators, televisions, mattresses, etc.
A. 
Garbage and ashes shall be deposited in containers which do not exceed 75 pounds in weight. The Seawanhaka Yacht Club and other may deposit its garbage in approved commercial dumpsters. Garbage containers, other than those used for recyclables, shall be provided by the owner or occupant of the premises and shall be maintained in a sanitary condition at all times. Any container which does not conform to these provisions or that may have ragged or sharp edges or any other defect liable to hamper or injure the collector shall be promptly replaced upon notice from the Village. The Village shall have the authority to refuse collection for any failure to comply herewith. Garbage containers shall be commercially manufactured, equipped with suitable handles and tight-fitting covers and be watertight. Bags may be used for garbage and must be used for ashes, provided that such bags are securely tied at the top and are not overfilled, torn, ripped or otherwise not capable of being lifted and placed in a garbage truck. The maximum size bag for garbage is 30 gallons.
B. 
Recyclables shall be placed in two different-colored containers, which the Village will provide free of charge to each homeowner. Upon request to the Village Clerk, the Village will provide additional containers to homeowners at the cost to the Village. Recyclable metals and glass shall be placed inside the blue container and plastics in the red container. Newspapers shall be bundled and securely tied with a strong cord. Such bundles may not exceed one foot in height.
C. 
Broken glass and metal with jagged/sharp edges shall be packaged in such a way as to prevent injury to the handlers.
D. 
Leaves should be swept or blown and compactly stacked at the edge of the road on one's own property. Where a property does not have road frontage, special arrangements must be made with the Village for collection.
E. 
Garbage containers shall be placed for collection in a conveniently accessible area on the premises and shall be secured in such a manner as to prevent access by animals to the contents.
A. 
Collection of garbage and recyclables shall be collected according to a schedule to be prepared by the Trustees or their designee.
B. 
Disposal of hazardous materials. As long as the Town of Oyster Bay refuses to accept deliveries from the Village of Centre Island, it shall be the responsibility of the individual to dispose of such materials.
C. 
Collection of rubbish shall be quarterly after arrangements have been made by calling the Village Clerk for a special pickup identifying what items are to be picked up. All appliances shall have their doors removed.
D. 
Construction materials. No construction materials or building rubbish from construction or remodeling will be picked up by the Village.
E. 
Collection of leaves shall be according to a schedule to be prepared by the Trustees or their designee, generally only during the month of November.
The Village shall have the right to refuse to collect during the continuation of any violation of this Article.
Any person knowingly placing hazardous products in a receptacle for collection shall be guilty of committing a violation under the Penal Law of the State of New York and is punishable by a fine of up to $250. Each day the violation continues shall be deemed a separate and distinct offense hereunder.
