This chapter shall be supplemental in addition to the provisions
of the New York State Department of Motor Vehicles Vehicle and Traffic
Law relating to vehicles and not in conflict therewith.
As used in this chapter, the following terms shall have the
meanings indicated:
BICYCLE
Defined as in the Vehicle and Traffic Law § 102.
OPERATE
Includes riding or propelling.
No person who is a resident of the Village of Mount Morris shall
operate a bicycle on the public highways, streets, avenues, walks
and public places within the Village unless such bicycle has been
inspected and registered by the Chief of Police, and a certificate
or tag of such inspection and registration containing a distinctive
identification number shall be attached to such bicycle.

Application for bicycle registration and inspection and for
a certificate, tag or registration and inspection shall be made upon
a form provided by the Village and shall be made to the Chief of Police
or other designated official or service organization. An annual registration
fee as shall be set from time to time by resolution of the Village
Board of Trustees shall be made to the Village before each registration
or renewal thereon is granted.
The Chief of Police or other designated official or service
organization, upon receiving the proper application therefor, is authorized
to issue a bicycle registration, which shall be effective until the
next succeeding first day of May.
The Chief of Police or other designated official or service
organization shall not issue a registration for any bicycle in case
he knows or has reasonable grounds to believe that the applicant is
not the owner of or is not entitled to the possession of such bicycle.
The Chief of Police or other designated official or service
organization shall keep a record of the number of each registration,
the date issued, the name and address of the person to whom it was
issued, the number on the frame of the bicycle for which issued and
the name of any child under 16, if any, for whose use the bicycle
is being registered and such other matters as the Chief of Police
or other designated official or service organization deems necessary,
in his or its discretion.
The Chief of Police or other designated official or service
organization, upon issuing a bicycle registration, shall also issue
a registration certificate or tag bearing the registration number
assigned to the bicycle for the calendar year in which issued and
shall cause such certificate or tag to be attached to the bicycle.
The Chief of Police or other designated official or service
organization shall inspect or cause to be inspected each bicycle before
licensing the same and shall refuse a license for any bicycle which
he or it determines is in unsafe mechanical condition or which is
not equipped in conformity with the requirements of law.
Upon the expiration of any bicycle registration, the same may
be renewed upon application and payment of the same fee as upon an
original application.
Every person, partnership, association or corporation in the
Villages or towns of Livingston County engaged in the business of
buying or selling new or secondhand bicycles shall make a report to
the Chief of Police or other designated official or service organization
for every bicycle purchased or sold by such dealer, giving the name
and address of the person from whom purchased or to whom sold, a description
of such a bicycle by name or make, the frame number therefor and the
number of the registration certificate or tag or marking, if any,
found.
Every person riding a bicycle upon the public highways, streets,
avenues, walks, parks and public places within the Village of Mount
Morris shall be subject to the traffic regulations in the Vehicle
and Traffic Law applicable to bicycles and also to the traffic regulations
of the Village of Mount Morris applicable to bicycles.
A. Any person operating a bicycle shall obey the instructions of official
traffic signals, signs or other control devices applicable to vehicles,
unless otherwise directed by a police officer.
B. Any person operating a bicycle shall signal all turns and stops,
using the standard hand signals.
C. Whenever authorized signs are erected indicating that no right turn,
left turn or U-turn is permitted, no person operating a bicycle shall
disobey the direction of any such sign, except where such person dismounts
from the bicycle and then makes the turn, in which event such person
shall obey the regulations applicable to pedestrians.
A. A person propelling a bicycle shall not ride other than upon or astride
a permanent and regular seat attached thereto, nor shall be ride with
his feet removed from the pedals.
B. No bicycle shall be used to carry more persons at one time than the
number for which it is designed and equipped.
Every person operating a bicycle within the Village of Mount
Morris shall operate such bicycle in a careful and prudent manner
and at a rate of speed so as not to endanger the property of another
or the life and limb of any person.
A. Every person operating a bicycle upon a roadway shall ride as near
to the right side of the roadway as practicable, exercising due care
when passing a vehicle or bicycle standing or proceeding in the same
direction.
B. Persons riding bicycles upon a roadway shall not ride more than two
abreast, except on paths of roadways set aside for the exclusive use
of bicycles.
C. Whenever a usable path for bicycles has been provided adjacent to
a roadway, bicycle riders shall use such path and shall not use the
roadway.
Every person operating a bicycle, when emerging from an alley,
driveway or building, shall stop such bicycle immediately before entering
the intersection, sidewalk, street, highway or roadway and thereafter
shall enter such sidewalk, street, highway or roadway with care.
No person operating a bicycle shall attach the same or himself
or his hand to any automobile, truck or other vehicle whatsoever.
No person operating a bicycle shall carry any package, bundle
or article which prevents the driver from keeping at least one hand
upon the handlebars.
A. Every bicycle, when in use during the period from 1/2 hour after
sunset to 1/2 hour before sunrise, shall be equipped with a lamp on
the front which shall emit a white light visible from a distance of
at least 500 feet to the front and with a red reflector at least three
inches in diameter on the rear and of a type approved by the Commissioner,
which shall be visible from all distances from 50 feet to 300 feet
to the rear when directly in front of lawful upper headlamps on a
motor vehicle. A lamp emitting a red light visible to the rear may
be used in addition to the red reflector.
B. No person shall operate a bicycle unless it is equipped with a bell
or other device capable of giving a signal audible for a distance
of at least 100 feet, except that a bicycle shall not be equipped
with nor shall any person use a bicycle with any siren or whistle.
No person shall park a bicycle upon a highway, street or avenue
other than upon the roadway against the curb or upon the sidewalk
in a rack that supports the bicycle or against a building or at the
curb in such a manner as to afford the least obstruction to pedestrian
traffic.

No person shall ride a bicycle upon any sidewalk or footpath
in the Village of Mount Morris, with the exception of Main Street,
Chapel Street and State Street, within the business district, where
all bicycles must be walked.
The parent of any child and the guardian of any ward shall not
authorize or knowingly permit any such child or ward to violate any
of the provisions of this chapter.
The registrant of a bicycle shall not authorize or knowingly
permit a bicycle registered under this chapter to be operated in violation
of this chapter.
Every resident of the Village of Mount Morris operating a bicycle
which is in any manner involved in an accident within the boundaries
of said Village in which any person is killed or injured shall forthwith
report the matter to the Chief of Police. Failure to report an accident
as herein provided shall be a violation of this chapter.
In accordance with Vehicle and Traffic Law § 1236(d),
the Commissioner of Motor Vehicles has issued regulations regarding
reflectorization standards of this chapter. Besides the continued
use of a white front light and a red reflex reflector, the new standards
include the use of reflectorized pedals and tires or rims. These additions
will provide instant identification of the bicycle by the motorist.
The reflectorized pedals will give the approaching motorist a visual
strobe effect as they turn. From the side, they will be seen as strips
of revolving color which will join with the reflectorized wheel hoops
for instant recognition. The wheel hoops are achieved through the
use of either open beading material vulcanized into the tire carcass
or tape or paint applied to the wheel rim, depending on the type of
brake system. A three-sixteenths-inch circular band will provide 16
square inches of reflective surface.
A. Any person 16 years of age or under who violates any of the provisions
of this chapter relating to the Vehicle and Traffic Law or safe riding
rules and regulations and the official police instructions for the
safe operation of a bicycle shall be, for the first offense, reprimanded,
in writing, by the Police Department or other designated official
or service organization, addressed to the parents or guardian of the
offender, stating the nature of the violation and warning that a repetition
of the violation, or any other violation, must be prevented by the
parents or guardian or the offender's registration certificate
will be suspended for a period of time at the discretion of the Police
Department, and during that period of time, the offender cannot ride
his or her bicycle on the streets or highways. On the second offense,
the offender will be summoned to appear at police headquarters with
his or her bicycle, accompanied by a parent or guardian, and after
a hearing on the violation, if, in the discretion of the Chief of
Police and/or Bike Safety Commissioner or his representative, it is
decided to punish the offender for the violation, the offender's
bicycle may be impounded for a period of time not to exceed seven
days, at the discretion of the Chief of Police or his representative,
with the approval, if possible, of the parent or guardian, but the
decision of the Chief of Police and/or Bike Safety Commissioner shall
prevail, and the bicycle shall be impounded. It is ordained that no
violation of this chapter relating to the Vehicle and Traffic Law
or the safe bicycle riding rules and the official police instructions
for the safe operation of a bicycle shall be considered a criminal
offense or made a matter of court record where the offender is 16
years of age or under.
B. Any person 17 years of age or over who violates any provision of
this chapter relating to the Vehicle and Traffic Law or safe riding
rules and regulations and the official police instructions for the
safe operation of a bicycle shall, upon conviction, be punishable
by a fine not to exceed $250 or by imprisonment for a term of not
more than 15 days, or both.

A. The place of registration and inspection for all bicycles in the
Village of Mount Morris will be the Mount Morris Police Department
Headquarters at 103 Main Street in the Village of Mount Morris.
B. The time for inspection and registration shall be from 9:00 a.m.
to 1:00 p.m.

I will register and have their bicycles inspected on the first Saturday
of August.
(2) People with last names beginning with the letters from J through
R will register and have their bicycles inspected on the second Saturday
of August.
(3) People with last names beginning with the letters from S through
Z will register and have their bicycles inspected on the third Saturday
of August.
