This chapter shall be known and may be cited as the "Village of Greenwood Lake Fire Lane Law."
The purpose of this chapter is to regulate the stopping, standing or parking of any vehicle at any time in any area hereinafter established by the Board of Trustees of the Village of Greenwood Lake or its designee as a fire lane in order to prevent obstruction of or interference with the ingress and egress of emergency vehicles for the protection of persons and property pursuant to § 1640-a of the Vehicle and Traffic Law of the State of New York and Fire Code Section 503 of the New York State Uniform Fire Prevention and Building Code governing Fire Department and emergency service access.

As used in this chapter, the following terms shall have the meanings indicated:
AUTHORIZED EMERGENCY VEHICLE
Every ambulance, police vehicle, fire vehicle, civil defense emergency vehicle and ordnance disposal vehicle of the Armed Forces of the United States.
COMMERCIAL VEHICLE
Any vehicle engaged in the delivery and/or loading of merchandise, supplies or other material or the rendering of services to stores or business establishments.
EMERGENCY OPERATION
The operation or parking of an authorized emergency vehicle when such vehicle is engaged in transporting a sick or injured person, pursuing an actual or suspected violator of the law or responding to or working or assisting at the scene of an accident, authorized emergency training exercise, disaster, police call, alarm or fire or other emergency. Emergency operation shall not include returning from such service.
FIRE LANE
Any zone or area established as such pursuant to this chapter.
PARKING
The standing of a vehicle, whether occupied or not, otherwise than temporarily, for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
RESIDENT
A person who resides in the Village of Greenwood lake or pays real property taxes to the Village of Greenwood Lake.
STANDING
The stopping of a vehicle, whether occupied or not, otherwise than temporarily, for the purpose of and while actually engaged in receiving or discharging passengers.
STOPPING
When prohibited, any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal.
VEHICLE
Every device in which any person or property may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
VILLAGE
The Village of Greenwood Lake, situated in Orange County in the State of New York.
This chapter applies only to the fire lanes established by the Board of Trustees of the Village of Greenwood Lake or its designee pursuant to this chapter or any amendment thereto.
The stopping, standing or parking of any vehicle in any area established by the Board of Trustees of the Village of Greenwood Lake or its designee and marked "fire lane" within the geographical limits of the Village of Greenwood Lake is hereby prohibited, unless herein and hereafter expressly permitted.
The prohibition contained in § 55-5 hereof shall not apply to:
A. 
Commercial vehicles parked at loading docks or service entrances to stores or business establishments while said commercial vehicles are actively engaged in the delivery and/or loading of merchandise, supplies or other material or the rendering of services to such stores or business establishments.
B. 
Authorized emergency vehicles engaged in emergency operation within the particular location of the fire lane.
C. 
All public transit buses or any other services to persons or property within the particular location of the fire lane.
A. 
The Board of Trustees of the Village of Greenwood Lake or its designee may designate any areas at or near any interior street, roadway, driveway or parking area in which any obstruction due to the parking or placing therein of any vehicle or physical object will cause interference with the ingress and egress of fire-fighting equipment or authorized emergency vehicles or which may create a condition dangerous to life or property in the event of a fire.
B. 
The designated areas shall thereupon be marked with the standard signs and/or such other markings and signs which conform to accepted sign standards, as set forth in the New York State Manual of Uniform Traffic Control Devices, which are deemed necessary and proper by the Board of Trustees of the Village of Greenwood Lake or its designee.
A. 
Any person, persons, firm, association, partnership or corporation violating the provisions of § 55-5 of this chapter shall be guilty of a traffic infraction and shall, upon conviction thereof, be subject to a fine not exceeding $250 or imprisonment not exceeding 15 days, or both.
B. 
Any conviction for the violation of § 55-5 of this chapter shall additionally subject such violator to such penalties as are provided by § 401, Subdivision 5a, of the Vehicle and Traffic Law of the State of New York,[1] and such further penalties as may be provided by the Vehicle and Traffic Law of the State of New York.

C. 
For each day in which the violation of this chapter remains, it shall be considered a separate offense.
A. 
The enforcement of this chapter and rules and regulations promulgated pursuant thereto will be by the Village of Greenwood Lake Police Department and by such special persons as may be from time to time authorized by the Board of Trustees of the Village of Greenwood Lake.
B. 
Any vehicle stopped, standing or parked in a fire lane may be removed therefrom and stored at the direction of the Village of Greenwood Lake's Police Department. The owner or operator of such vehicle shall be liable to the Village of Greenwood Lake or its designee for the payment of reasonable charges for such removal and storage of any such vehicle.
Fire lanes established by the Board of Trustees of the Village of Greenwood Lake or its designee under this chapter and future resolutions are as follows:
A. 
The fire lane as established at the Greenwood Lake Elementary School: a twenty-foot fire zone from the building's South side to Elm Street.
B. 
Grand Union Shopping Center.
(1) 
The fire lane as established at the Grand Union Shopping Center, Windermere Avenue, between property Section No. 305-3-5.22 and Walnut Street, as described: a fire zone extending six feet from the outermost part of the existing overhang with five-minute angled parking allowed for a maximum of seven vehicles in front of the properties now known as "Trinkets and Treasures" and the "United States Post Office," the entire area being 80 feet in length and encompassed by a fire zone 24 feet from the building line. Signs, barriers and striping will be installed and maintained at the expense of the owners of record and/or their tenants.
(2) 
This subsection is effective October 1, 1991, for a trial period of six months, after which, if proven unsuccessful, it will revert to the following: a zone extending a distance of 24 feet from the front building line to the parking area on the entire frontage of the stores and United States Post Office. Both descriptions include a twenty-four-foot lane from Windermere Avenue to the building line and from the building line to Walnut Street.
C. 
The fire lane as established at Windermere Avenue and Walnut Street: at Cumberland Farms an eight-foot fire zone from the front building line.
D. 
The fire lane as established at Windermere Avenue and Orchard Street: at Dairy Mart a six-foot fire zone facing Windermere Avenue.
E. 
The fire lane as established by Cove Marina, Jersey Avenue (Route 210): a sixteen-foot fire lane from Jersey Avenue to the boat ramp.
F. 
The fire lane as established at Long Pond Marina, Jersey Avenue (Route 210): a sixteen-foot fire lane from Jersey Avenue to the lower parking area.
G. 
The fire lane as established at Willow Point Marina, Jersey Avenue (Route 210): a sixteen-foot fire lane from Jersey Avenue to the beach area.
H. 
The fire lane at Breezy Point Inn: a sixteen-foot fire lane to be established from Jersey Avenue to the boat ramp.
I. 
The fire lane at North Shore Marina: a sixteen-foot fire lane to be established from Windermere Avenue to the boat ramp.
J. 
The fire lane as established on Waterstone Road running 223 feet in length and 30 feet in width from the westernmost corner of the Fire Department property to a point at the end of the property known as the "Police Department property." The parking of vehicles is hereby restricted to vehicles of Fire Department personnel only in the area of the Fire Department parking lot so designated for that purpose by signs and/or markings, and the parking of any other vehicle is hereby prohibited at any time.
If any portion, subsection, sentence, clause, phrase or portion thereof of this chapter is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not effect the validity of the remaining portion thereof.
This chapter shall take effect immediately upon its filing in the office of the Secretary of State of the State of New York.
