A. 
This chapter establishes a Water Pollution Control Commission to aid the City Council in the establishment and implementation of a user charge system as herein defined, which user charge system is created to fund the city's wastewater collection and treatment system for the intended purpose of maintaining an adequate and appropriate system to prevent unhealthy conditions or the pollution of the area's waters.
B. 
Whereas the City of West Haven has constructed a wastewater treatment works; and whereas it is the city's intent to establish proportionate user charges that place the costs of abatement directly on the sources of pollution, conserve potable water and maintain financial self-sufficiency; and whereas the city must pay the operation and maintenance expenses associated with said treatment works and charge the users of said treatment works accordingly, now, therefore, the following Water Pollution Control Commission and user charges are established.
This chapter is intended to:
A. 
Create a Water Pollution Control Commission.
B. 
Establish the Water Pollution Control Commission's powers.
C. 
Establish a user charge system.
A. 
This chapter shall apply to the city and to persons outside the city who are users of the public sewer.
B. 
All Articles of Chapter 191 of the West Haven Code, entitled "Sewers," which regulate the construction of, connection to and all other aspects pertaining to use of the public sewer system shall continue to govern. Thus, no sewer use provisions are established herein.
