The Buffalo Valley Telephone Company, its successors or assigns, its or their agents, servants and employes are permitted to erect and maintain in and over Cherry Alley from its eastern to its western terminus; and Fifth Street, from its northern to southern terminus for the principal line or lines of poles and wires together with all other side streets and alleys in said Borough for a line or lines of poles and wires for telephone connection, with all such necessary and usual fixtures therefor as may be necessary for the successful prosecution of a telephone or signal business by means of electricity.[1]

Editor's Note: The preamble to this ordinance stated that the Buffalo Valley Telephone Company had applied to the authorities of the Borough for permission to erect poles and run wires on the poles, over the streets and alleys of the Borough; Section 4 of the ordinance provided that the Company make a telephone connection and place a telephone in the office of the Town Clerk for the use of the Borough, without charge, a provision no longer carried out because of prohibitions in the Public Utility Law against free service; Section 5 provided that the Company was not to exceed its present rates for phone service beyond a reasonable amount, and as nearly as possible maintain the present rates agreed upon, the latter provision not applicable at present, having been supplanted by provisions of the Public Utility Law, giving the Public Utility Commission authority over rates. Section 5 also provided that the ordinance be published at Company expense.

The poles shall be reasonably straight and with the fixtures so to be erected shall be put in a safe and substantial manner, and shall be as neat in appearance as may be, and shall be located by a committee of Council together with the Electric Light Superintendent under their direction in such manner as not to obstruct said Fifth Street and alleys in their ordinary and customary use and shall be erected, maintained and cared for at the cost and charge of said Company.

The said Company shall be allowed the privilege of running and fastening the telephone wire to the Borough electric light poles, for connecting with buildings, at such place where it is not convenient for said Company to erect a pole of their own, provided that the Borough of Mifflinburg, Pennsylvania, will be granted the same privilege of running and fastening their electric light wires to the poles of the said telephone company for connecting light service at such places where it is not convenient for said Borough to erect a pole of their own.
