The provisions of this article shall apply except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.
A. 
The parking of vehicles is hereby prohibited on all highways within the Village of Nyack between the hours of 3:00 a.m. and 6:00 a.m. except to the extent permitted for noncommercial vehicles under § 330-54, Overnight alternate-side-of-the-street parking.

B. 
The parking of vehicles is hereby prohibited in all municipal parking lots within the Village of Nyack between the hours of 3:00 a.m. and 6:00 a.m., except for parking with a permit issued by the Village of Nyack.

C. 
Any person found guilty of a violation of § 330-50 shall be subject to a penalty of $25.

D. 
The parking of vehicles below the eastern end of Depew Avenue within the boundaries of Memorial Park is prohibited between the hours of 11:00 p.m. and 6:00 a.m.

E. 
It shall be unlawful for a person, driver or operator to park a truck or other vehicle designed or operated mainly for the commercial transportation of property, the body weight of which exceeds 2,000 pounds, in or upon any street, road or alley within the boundaries of the Village of Nyack during the hours of each day commencing at 7:00 p.m. and ending at 6:00 a.m. the morning following. Additionally, the above-mentioned vehicles shall be prohibited from parking in or upon any street, road or alley within the boundaries of the Village of Nyack at any time unless engaged in the loading or unloading of property. This section shall not apply to nor prohibit the stopping, standing or parking of fire-fighting equipment and vehicles or emergency vehicles, nor to public utilities and contractors while engaged in the repair, maintenance or construction of streets or street utilities within the Village.

Highland Avenue (Route 9W) along the west side beginning at a point 192 feet from the southern curbline of Sickles Avenue and continuing south along the west curbline of Highland Avenue to 232 feet.[2]

A. 
The parking of vehicles is hereby prohibited on any public street in Parking Meter Zone A on any day for any continuous period of time exceeding three hours. Time limits on parking in public parking lots (or in private parking lots with agreements in place with the Village of Nyack to utilize and enforce parking restrictions in such private lots) shall be as posted.
B. 
The Parking Authority shall have the authority to modify the three-hour limit in locations where, in the judgment of the Authority, such a limit serves no purpose or will create a hardship due to the absence of off-street parking or for other reasons memorialized in the minutes of the meetings of the Authority. The Parking Authority shall proclaim the enforcement or the amelioration of this rule by appropriate signage when necessary, but the failure to post three-hour parking limit signs throughout the Village is specifically not required.

A. 
Pursuant to § 1640, Subdivision (a), of the Vehicle and Traffic Law, the Board of Trustees of the Village of Nyack may by resolution designate specific reserved parking spaces on public streets and property for the use solely by motor vehicles registered in accordance with § 404-a of the Vehicle and Traffic Law.
B. 
Upon receipt of a written request made by the owner of private property, the Board of Trustees may by resolution designate reserved parking spaces on privately owned property for the use solely by motor vehicles registered in accordance with § 404-a of the Vehicle and Traffic Law.
C. 
The parking spaces designated pursuant to the provisions of this section shall be clearly identified for use by handicapped persons, and each such space shall be identified by the use of either blue lines and the international symbol of access or by the uniform sign authorized for handicapped parking by the Department of Transportation, Federal Highway Administration.

D. 
Except as otherwise provided by local law, any person who parks a motor vehicle not registered in accordance with state law and not being used for the transportation of a handicapped person in a space identified for use by the handicapped when there is visible any one of the following markings: blue lines, the international symbol of access, the uniform sign authorized for handicapped parking by the Department of Transportation, Federal Highway Administration or any combination of the above, shall be subject to a maximum fine of $110 for the first offense and a maximum fine of $220 for the second offense.

E. 
The owner or operator of any motor vehicle parked in violation of this section, in addition to any other penalties which may be imposed, shall be liable for any expenses incurred by the Village in towing said unlawfully parked motor vehicle, such charges not to exceed the actual cost incurred, together with any charges for storage.
F. 
The Board of Trustees, upon public notice of the proposed space, shall designate reserved spaces to be used solely by motor vehicles in accordance with this section of this Code and shall keep a record of the same in the Village Clerk's office.

Overnight alternate-side-of-the-street parking is permitted as posted, and on the streets listed in Subsection C below, commencing January 1, 1993.

North-south streets, unless otherwise posted, parking shall be permitted between 3:00 a.m. and 6:00 a.m. on the east side of the street only on Sundays, Mondays, Wednesdays and Fridays and on the west side of the street only on Tuesdays, Thursdays and Saturdays.
(2) 
East-west streets, unless otherwise posted, parking shall be permitted between 3:00 a.m. and 6:00 a.m. on the north side of the street only on Sundays, Mondays, Wednesdays and Fridays and on the south side of the street only on Tuesdays, Thursdays and Saturdays.
C. 
The streets subject to this overnight parking exception are: all streets and highways in the Village of Nyack except Broadway, Main Street, Route 9W and the streets set forth above in § 330-50B and D.

D. 
This section applies to vehicles bearing noncommercial plates only. Vehicles bearing commercial plates may not park on any street in Nyack between the hours of 3:00 a.m. and 6:00 a.m.

The Nyack Village Board shall be authorized, in its discretion, to authorize, by local law or resolution, the posting of special parking restrictions on a per diem basis, notwithstanding any other provision of the Village Code. Such special parking restrictions shall be for special circumstances or designated events, including but not limited to posted no parking zones for snow emergencies or other special events, and designated parking spaces for special events, handicapped parking and work zones.

A. 
Loading zones shall be in effect between the hours of 9:00 a.m. and 6:00 p.m., during which hours the stopping of any vehicle for the purpose of loading or unloading shall be permitted in spaces expressly designated by signs stating "Loading Zone."

(1) 
A list of all loading zone spaces shall be maintained by the Traffic Department and may be amended from time to time by resolution of the Nyack Village Board.
(2) 
No vehicle shall be left attended or unattended in a designated loading zone for any continuous period of time exceeding 15 minutes.
B. 
Limited time zones.
(1) 
The parking of vehicles in limited time zones shall be permitted for any continuous period of time that does not exceed 15 minutes in spaces expressly designated limited time zone.
(2) 
A list of all limited time zone spaces shall be maintained by the Traffic Department and may be amended from time to time by resolution of the Nyack Village Board.
C. 
Official vehicle zones.

(1) 
The stopping of any vehicle designated an official vehicle by the Nyack Traffic Department shall be permitted in spaces expressly designated by signs stating "Official vehicles only."
(2) 
A list of all official vehicle zones shall be maintained by the Traffic Department and may be amended from time to time by resolution of the Nyack Village Board.

A. 
Any person violating any provision of this article, or of any ordinance, order, rule or regulation adopted pursuant to § 1630 or § 1631 of the Vehicle and Traffic Law of the State of New York, may, upon conviction, be punished by a fine of not less than $5 nor more than $250 or by imprisonment for not more than five days, or both. The provisions contained herein regarding the imposition of fines or other penalties shall also apply to any firm or corporation which violates any provision of this article.
B. 
In addition to the penalties referenced in § 330-57A, any costs or fees incurred in connection with the collection of outstanding past due parking tickets shall be assessed to the violator.
The following ordinances or parts of ordinances are hereby specifically repealed.

A. 
This article shall take effect from and after the 10th day after the passing of said resolution except those parts, if any, which are subject to approval under § 1684 of the Vehicle and Traffic Law and § 46 of the Highway Law of the State of New York.
B. 
Any part or parts of this article which are subject to approval under § 1684 of the Vehicle and Traffic Law and § 46 of the Highway Law of the State of New York shall take effect from and after the day on which approval in writing is received from the New York State Department of Transportation.
