The establishment and maintenance of any property to be used
and maintained for the collection, storage and sale of new or used
vehicles shall be subject to the following regulations:
A. No motor vehicle shall be so placed on any lot that any part of the
vehicle shall be nearer than 100 feet to the nearest point of any
dwelling house, whether occupied or not.
B. Any property used for the collection, storage and sale of vehicles
shall be at least 100 feet in width and 50 feet in length.
C. Such property shall be sufficiently illuminated between dusk and
dawn and at all times when visibility may be poor.
D. Such property shall contain a building or an office trailer used
exclusively in conjunction with the sale, collection and storage of
new or used vehicles.
E. Such property shall be separate and reserved solely and exclusively
for the sale, collection and storage of new or used vehicles.
F. All vehicles placed on such property shall be placed on a line parallel
to the street. There shall be an opening or passageway of at least
six feet in width between each set of six vehicles in said line. Should
there be more than one line of vehicles on any such property, there
shall be a passageway between each set of lines of at least 10 feet
in width.
G. The owner, occupant or lessee of any such property shall have in
his possession a title for each vehicle on the property.
H. The owner, occupant or lessee of any such property shall at all times
keep and maintain adequate records of vehicles bought, sold and stored
on the property.
I. The sale of used vehicle parts is prohibited.
J. The Borough of Trainer shall have the right, at all reasonable times, to enter upon the subject premises and inspect the property and all documents and business records for compliance with the provisions of Subsections
A through
I of this section.

The establishment and maintenance of any property to be used
and maintained for the collection, storage and sale of new or used
vehicles shall be subject to the following licensing requirements:
A. Prior to the initial use or maintenance of any property for the collection,
storage and sale of used or new vehicles, the owner, occupant or lessee
of any such property shall file an application with the Borough Secretary.
The application shall be reviewed by Borough Council. The applicant
may only begin to use the subject property for the collection, storage
and sale of used or new vehicles after the application has been approved,
the applicable license fee paid, and the license issued.
B. The owner, occupant or lessee of any property which is used or maintained
for the collection, storage and sale of new or used vehicles shall
apply with the Borough Secretary for a new license and at the same
time provide the Borough Secretary with the applicable license fee
within 30 days after January 1 of every year. In the event the license
application and fee has not been received by January 31 of any year,
a certified letter shall be sent to the owner, occupant or lessee
of the subject property. If the application and applicable license
fee is not received within 30 days thereafter, the license shall be
revoked and all business activities related to the sale, collection
and storage of new and used vehicles on the subject property shall
cease.
C. The license shall be conspicuously displayed on the subject property.
D. The yearly license fee for persons and entities engaging in the business
of automobile and motor vehicle sales and the collection and storage
of automobiles for sale is hereby increased:
(1) To the sum of $300 for all facilities that have 10 of fewer vehicles
stored and/or displayed for sale at any one time.
(2) To the sum of $400 for all facilities that have 11 to 20 vehicles
stored and/or displayed for sale at any one time.
(3) To the sum of $500 for all facilities that have more than 20 vehicles
stored and/or displayed for sale at any one time.

Any person, firm or corporation who shall violate any provision
of this article shall, upon conviction thereof, be sentenced to pay
a fine of not more than $100 and/or to imprisonment for a term not
to exceed 90 days. Every day that a violation of this article continues
shall constitute a separate offense.
