As used in this chapter, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
PARK or PARKS
Unless specifically limited, shall be deemed to include all parks, playgrounds, recreation areas, recreation structures and facilities, and also entrances and approaches thereto, and all other land or property or structures under the jurisdiction of the Borough Council now or hereafter owned or acquired by the Borough for park and/or recreation purposes.
PERSON
Any natural person, corporation, organization of persons, company, association or partnership.
RECREATION BOARD
A board of Trainer residents appointed and constituted as provided by law and possessing all the authority vested in borough recreation boards by law.[1]
RULES AND REGULATIONS
Any rules and regulations hereby or hereafter promulgated by the Recreation Board and/or Borough Council under the authority herein conferred.

For the purpose of promoting, supervising and maintaining athletic, social, cultural and other programs (under the approval or direction of Trainer Borough Council) for the good and welfare of the people residing in Trainer Borough, a park recreation board shall be appointed and constituted as provided by law and shall possess all the authority vested in borough recreation boards by law.

The following rules and regulations are hereby established for the management and protection of parks:
A. 
The parks shall be opened daily to the public between the hours of 8:00 a.m. and dusk, or not later than 9:00 p.m., whichever comes first. All activities in the parks shall cease and all persons in the parks shall leave as soon as possible thereafter. No person, other than authorized employees of the Borough, shall be in the parks at any time between dusk or 9:00 p.m. (whichever comes first) and 8:00 a.m. on the following morning.
B. 
No person shall injure, deface, remove, cut or damage any of the trees, plants, shrubs, flowers, turf, buildings, structures, signs or fixtures, or any other property of the Borough located in the park.
C. 
No person shall litter any area of the park with garbage, paper, bottles, cans or other waste materials; nor dispose of the same in any way except in receptacles designated for such purposes. In no case will the disposal of newsprint be permitted in any way, place or manner within any park.
D. 
No person shall kindle or maintain any fire in the park except in fireplaces or areas specially designated for that purpose and located by authority of the Recreation Board and/or Borough Council.
E. 
No person shall remove any bench, seat, table or other appliance or change the location thereof without permission of the Recreation Board and/or Borough Council.
F. 
No persons shall injure, deface, destroy or remove any notice, rule or regulation posted at any place within the park by authority of the Recreation Board and/or Borough Council; nor shall any notice or placard be posted within the park other than by authority of the Recreation Board and/or Borough Council.
G. 
No person shall conduct himself within the park so as to annoy any other person using the park for recreational purposes.
H. 
No person shall set up any booth, table or stand for the sale of any article or service whatsoever within the limits of the park without first receiving permission of the Recreation Board and/or Borough Council; distribute, sell, service or rent any service or commodity or solicit for any purpose without permission of the Recreation Board and/or Borough Council.
I. 
No person shall operate, stop or park any vehicle, bicycle or other means of conveyance except in areas where permitted or designated by proper authority of the Recreation Board and/or Borough Council, or operate the same in a reckless or negligent manner or in excess of any posted speed limit or in such a manner as to become a nuisance to other area users.
J. 
No person shall operate commercial vehicles, unless providing authorized services.
K. 
No person shall bring onto the premises, possess or consume any alcoholic beverage or illegal drugs of any kind; no person shall enter the park in an intoxicated state or otherwise be under the influence of alcohol or illegal drugs.
L. 
No persons shall carry or discharge any firearms, slingshots, firecrackers, fireworks or other missile-propelling instruments or explosives or arrows, or other dangerous weapons which have such properties as to cause annoyance or injury to any person or property, unless permission has been granted by the Recreation Board and/or Borough Council in designated areas; police officers in the performance of their duties will be exempt from these provisions.
M. 
No persons shall play ball, swim, golf, pitch horseshoes, engage in archery, camp or engage in finding buried objects with special detectors, or participate in any other form of recreation, sporting endeavor or pastime, except in those areas which may be designated from time to time for that purpose by the Recreation Board and/or Borough Council.
N. 
No persons shall disrobe or change clothes except in buildings or facilities made available for that purpose.
O. 
No persons shall operate a snowmobile, minibike, dirt bike, motorcycle or any vehicle, recreational or otherwise, except on designated roads, trails or areas set aside for their use; however, a duly licensed motorcycle driven by a duly licensed operator on the vehicular roadways will be permitted within the limits set forth elsewhere in this document.
P. 
No person shall use threatening, abusive, insulting, profane or obscene language or words.
Q. 
No persons shall commit any disorderly or immoral acts.
R. 
No person shall hold any public meeting or rally with more than five persons or engage in any marching or driving as members of a military, political or other organization without permission of the Recreation Board and/or Borough Council, which shall require a statement of information, including the name of the organization, its purpose, number of persons expected to be in attendance, expected duration and name(s) of person(s) in charge and responsible.
S. 
No person shall disobey a proper order of a police officer or member of the Recreation Board and/or Borough Council, or disobey or disregard or fail to comply with any rule or regulation, warning, prohibition, instruction or direction given by an authorized person and posted or displayed by sign, notice, bulletin, card, poster or when notified or informed as to its existence by the Recreation Board and/or Borough Council or an authorized person.
T. 
No person shall hunt for, capture or kill or attempt to capture or kill, or aid or assist in the capturing or killing of, in any manner, any wild bird or wild animal of any description, either game or otherwise, except those commonly known as “rats,” and to that end it is unlawful for any person to carry onto or possess in any public park or any property owned or controlled by the Borough a shotgun or rifle or pistol or firearm of any make or weapon as defined under § 120-2 unless specific permission is granted for a designated area by authority of the Recreation Board and/or Borough Council.

U. 
No person shall allow pets to run at large out of control, to ride, walk, run, feed or graze horses, cattle or any animals of any kind within any park, unless providing an authorized service.
The use of all parks and/or equipment, buildings and facilities shall be on a first-come, first-served basis unless otherwise reserved:
A. 
By annual permission granted by the Recreation Board and/or Borough Council for the scheduling of various league games, etc.;
B. 
For regularly scheduled municipal recreation programs; or
C. 
By permission granted by the Recreation Board and/or Borough Council for a specific requested use.
The Recreation Board is authorized to establish additional rules and regulations as deemed necessary and with approval of the Borough Council.
Recreation facilities which become hazardous for public use due to weather, water, fire or unforeseeable conditions may be closed only at the discretion of the Recreation Board and/or Borough Council or the Mayor of Trainer Borough.
The police officers of Trainer Borough are charged with enforcement of the provisions of this chapter and the rules and regulations promulgated by either the Recreation Board and/or Borough Council.

Any person, firm or corporation who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $600 and/or to imprisonment for a term not to exceed 90 days.
The tract of land located in the Borough of Trainer between Ninth Street and Township Line Road, owned by the Borough, having heretofore been established as a public park of the Borough, has been designated "Henry Johnson Park."
