It shall be the duty of all owners, occupants and tenants of occupied properties and all owners, occupants and tenants of vacant ground in the Borough of Colwyn to cause said properties or vacant grounds to be kept clear of rubbish, garbage, weeds and long grass ("long grass" being defined as more than eight inches in height above the surface of the ground) on their respective premises. The Borough shall provide one notice per year to said owner, occupant and tenant, and if such owner, occupant or tenant aforesaid shall permit or suffer such rubbish, garbage, weeds and long grass to collect or remain thereon after notice from the Secretary of the Borough to remove the same, which notice shall be served on the owner, occupant or tenant of said property or mailed by regular United States mail to the owner of the same at his last known address, such owners, occupants or tenants shall be subject, upon the summary conviction thereof before a District Justice, to a fine of not more than $300 and costs of prosecution and, in default of payment thereof, shall undergo imprisonment in the Delaware County Prison for a period not exceeding 30 days.
If such owner, occupant or tenant shall not remove such rubbish, garbage, weeds or long grass from his property after notice from the Secretary of the Borough to remove the same, it shall be the duty of the Mayor of said Borough, upon the concurrence of the Borough Council, to effect the removal of the same, and the cost of such work, together with a penalty of 20% of such costs, shall be collected from the owner, occupant or tenant of such property in the manner provided by law for the collection of municipal claims or by action of assumpsit.
