A certain document, copies of which are on file in the office of the Code Enforcement Officer of Elizabeth Township, being marked and designated as the International Property Maintenance Code, 2021 Edition, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Township of Elizabeth regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary, and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, the demolition of such structures. Providing for the penalties, conditions and terms of said Property Maintenance Code on file in the office of the Township of Elizabeth are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in § 302.

The following sections are hereby revised:
Section 101.1. Insert: Township of Elizabeth.
Section 103.1. Insert: Code Enforcement Department.
Section 302.4. Replace with: Premises and exterior property shall be maintained free from weeds or grass growth in excess of eight inches in height; plant growth to the discretion of Township Code Enforcement or a Public Safety Officer. Noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs; provided, however, this term shall not include cultivated flowers and gardens.

In case any owner or occupant shall fail to comply with any notice to correct or abate any condition which may adversely affect the health and welfare of the public pursuant to the provisions of this chapter, the Township Code Enforcement Officer or Zoning Officer may elect to enter the property and proceed to have the condition removed, corrected or abated and shall charge said owner or occupant the actual cost to the Township for the labor involved, the material involved, and the use of equipment, together with a penalty of $500. Any charges remaining unpaid after 30 days' written notice shall be turned over to the Township Solicitor for collection in the manner provided by law for the collection of municipal claims or in an action at law before the Magisterial District Justice or the Court of Common Pleas.

The charges described above for labor, material, and equipment, together with a penalty of $500, shall only apply in the event that the Township elects to enter the property and proceeds to have the condition removed, corrected or abated. The Township is not required to remediate any such violations, but rather may elect to notify the property owner that the property owner is responsible for such abatement of violations.

In the event a violation of the International Property Maintenance Code, 2021 Edition, or a violation of a subsequent edition of the International Property Maintenance Code, as may be amended, has been found to occur, rather than impose the above procedure and charges, the Township may issue a citation, violation ticket and/or a notice of violation in addition to any other remedy or fine that the Township may be entitled to under its ordinances or other applicable law.
