Chapter 178 and the following sections shall be added to the Code of the Borough of Monaca.
The purpose of this chapter is to comply with the Pennsylvania Clean Indoor Air Act 35 P.S. § 637.1 et seq. and to further promote a safe and healthful environment for employees and the public in and around Borough buildings and facilities leased or owned by the Borough of Monaca. It is intended to reduce the health risks associated with exposure to environmental smoke.
As used in this chapter, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
MONACA BOROUGH BUILDINGS
Buildings owned or leased by the Borough of Monaca, which the Council designates as public places within the meaning set forth in the Clean Indoor Air Act, including but not limited to:
A. 
The Municipal Building located at 928 Pennsylvania Avenue.
B. 
The Monaca Pumphouse located at 599 Atlantic Avenue.
C. 
The Monaca Maintenance Building located at 900 Taylor Avenue.
D. 
The C.J. Mangin Building located at 998 Indiana Avenue.
E. 
The Sewage Treatment Plant located at 407 Pennsylvania Avenue.
F. 
The Monaca Public Library located at 609 Pennsylvania Avenue.
G. 
The Monaca V.F.D. No. 4 building located at 913 Taylor Avenue.
H. 
The Monaca V.F.D No. 5 building located at 800 Jackson Avenue.
SMOKING
The carrying by a person of a lighted cigar, cigarette, pipe or other lighted smoking device.
A. 
Smoking is prohibited in all the Monaca Borough buildings and facilities whether leased or owned by the Borough. Smoking is permitted on Monaca Borough property only in designated areas.
B. 
Smoking is permitted in any outdoor area 35 feet away from any entrance/exit, window or ventilation/air intake system of any Monaca Borough owned or leased building or facility; however, where such location would cause a person to be outside the boundaries of said Monaca Borough property, smoking is permitted at the furthest point from any entrance/exit, window or ventilation/air intake system of any Monaca Borough owned or leased building or facility which may be less than 35 feet.
C. 
Smoking is permitted in the following specifically designated outdoor areas:
(1) 
Municipal Building: 35 feet from the rear doors of the Municipal Building and the parking lot area.
(2) 
Monaca Pumphouse: Flagpole area or lower lawn area outside the side door.
(3) 
Monaca Highway Building: Door No. 1 and parking lot area nearest Taylor Avenue.
(4) 
C.J. Mangin Building: front sidewalk area.
(5) 
Sewage Treatment Plant: at the end of the loading dock.
(6) 
Monaca Public Library: parking lot area.
(7) 
Monaca V.F.D. No. 4 Building: end of driveway/parking lot area.
(8) 
Monaca V.P.D. No. 5 Building: parking lot area.
(9) 
Other outdoor areas designated by the Borough Manager consistent with the objectives set forth herein from time to time and reviewed and approved by the Council of the Borough of Monaca.
D. 
Receptacles shall be provided and maintained by the Borough of Monaca for the proper disposal of cigarette butts in areas designated as smoking areas herein. Cigarette buns shall only be discarded in the receptacles provided; the disposal of cigarette butts on the ground or in landscaping beds is prohibited.
E. 
All entrances to Monaca Borough owned or leased buildings and facilities shall be posted with appropriate signage as required by the Clean Indoor Air Act. Smoking-permitted signs shall be posted in areas specifically designated for smoking as set forth herein. Said signs shall be placed and properly maintained by the Borough of Monaca.
A. 
The Monaca Borough Police Department shall have authority to enforce the provisions of this chapter.
B. 
Any person who violates this chapter is guilty of a summary offense and shall be subject to a fine not to exceed $250. A repeat offense within a year shall be subject to a fine not to exceed $500. Offenses subsequent to a second offense shall be subject to a fine not to exceed $1,000.
C. 
This chapter repeals any and all ordinances previously adopted which are inconsistent with the provisions of this chapter.
This chapter shall become effective upon enactment hereof.
