No person or business entity shall engage in or carry on any business, trade or calling in the Township of Winslow, nor aid or assist, as employee, clerk or otherwise, in carrying on such business or in using any stand, store or other place or thing, nor sell or offer for sale any goods or things for which a license is required by the terms of this chapter, unless a license as herein provided for shall have been first obtained therefor by said person or business entity engaging in said business, trade or calling. In addition to the requirements of this chapter, an applicant applying for a license to operate or conduct business as a pawnbroker or dealer in secondhand goods shall also comply with the requirements of Chapter 192 of the Code of the Township of Winslow.

Application for license shall be made to the Township Clerk of the Township of Winslow, New Jersey, and the license shall specify by name the person, firm or corporation to which it is granted and the location at which such business, trade, profession or calling is to be carried on. In the event that the applicant is a corporation, the name and address of its registered agent must be included on the application. The certificate of license shall be conspicuously displayed on the premises where the business is conducted. In addition to the requirements of this chapter, any license issued to a pawnbroker or dealer in secondhand goods shall contain the information required by Chapter 192 of the Code of the Township of Winslow.

All new business applications shall first be referred to the Zoning Officer, who shall review same for ordinance compliance, and to determine the said primary purpose of said business, and forward his findings and recommendations to the Township Committee by filing with the Township Clerk. The Township Committee shall decide on granting or denying the license applied for. No license shall be issued for a new business until the Township Committee has authorized the issuance of the license. All persons or business entities presently in existence and required to be licensed, not heretofore licensed, shall apply for such license prior to May 1, 1991.

All renewal license fees shall be due and payable to the Township of Winslow at the office of the Township Clerk in the Township of Winslow, New Jersey, on or before the first day of April of each year, and all shall expire on the last day of April of the year following the issuance or renewal.

The license fee, to be paid annually as herein provided to the Township of Winslow, for conducting the business, trade, profession or occupation at the place designated in the license certificate issued therefor shall be in accordance with the schedule provided in this section. Initial licenses issued in the second half of the license period shall be prorated at 1/2 the license fee set forth; provided, however, that any prorated fee calculated at less than $30 shall require a minimum fee of $30.

No person or persons shall be allowed to transact any business under any license granted under this chapter except the business for which said license was specifically granted.
A. 
No license shall be issued to any person or entity who has not complied with the laws of the State of New Jersey or the ordinances of the Township of Winslow providing regulations respecting the safety of the persons who may have occasion to use the premises, place or thing licensed; and in case any person licensed fails to comply with such laws and ordinances after due notice and opportunity to be heard, the Township Committee may revoke such license.
B. 
No license provided for by this chapter shall be transferred from one person to another person, and no license shall cover any other place of business than that for which it was issued.
A. 
This chapter shall not apply to orders taken out of this township or to the soliciting of orders by wholesale dealers from retail dealers, or to deliveries by wholesale dealers to retail dealers, or to the sale or delivery of newspapers, magazines or periodicals.

B. 
This chapter shall not apply to any corporation authorized to transact business by the Department of Banking of the State of New Jersey, or to any corporation authorized to transact business by any department of the government of the United States, or to any person licensed to transact business by the State of New Jersey or any department, board or commission thereof, or to public utilities.
C. 
This chapter shall not apply to any resident situated within the Township who utilizes his own property for the selling of farm products locally grown within the Township.

If a license fee payment is not made in accordance with §§ 171-4 and 171-5, a late fee of $25 shall be charged for any person or businesses entity that does not obtain an annual renewal thereof prior to August 1.

The Clerk of the Township of Winslow shall turn over all said license fees collected by him to the Township Treasurer.

Except for a violation of § 171-13 below, any person, firm, association or corporation violating any section of this chapter shall, upon conviction before the Judge or other officer having jurisdiction, be subject to a fine not exceeding $500 or imprisonment in the county jail for a term not exceeding 30 days, or both, in the discretion of the Judge of the court where the violation has been heard. Any repetition of any violation of this chapter shall be deemed a new offense.

The local enforcing authority for purposes of ensuring compliance with and enforcement of all rules, regulations and requirements set forth in this chapter shall be the Winslow Township Zoning Officer.

A. 
Business insurance registration required. It is unlawful for any owner of a business to operate within the Township without first registering its certificate of insurance demonstrating compliance with Section 1 of P.L. 2022, c. 92.[1]

B. 
The following entities are required to register their certificate of insurance under this section:
(1) 
Businesses, which shall mean, any person intending to sell or dispose of or to offer to sell or dispose of any goods, wares, merchandise or render any services for fees within the Township. This shall include pawnbrokers and businesses operating on a temporary basis within the Township such as peddlers, solicitors, and transient vendors licensed pursuant to Township Code Chapter 199. Pawnbrokers shall be licensed pursuant to Township Code Chapter 192.
C. 
Business insurance registration will be processed through a third-party insurance verification program. Said registration will include a certificate of insurance reflecting the following amounts of insurance in compliance with P.L. 2022, c. 92.
(1) 
Except as provided in Subsection D(2) of this section, the owner of a business shall maintain liability insurance for negligent acts and omissions in an amount of no less than $500,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
D. 
Insurance registration.
(1) 
Business insurance registration, with the exception of peddlers, solicitors and pawnbrokers shall expire on the last day of April of each year. Renewals must be submitted by the first day of April of each year. After the effective date of this Section, entities covered under this Section shall be required to register by April 1, 2023.
(2) 
Pawnbrokers, peddlers and solicitor licenses shall expire the last day of June of each year. Renewals must be submitted by the first day of July of each year. After the effective date of this Section, entities covered under this Section shall be required to register by July 1, 2023.
E. 
Violations and penalties. Any person who violates the terms of this Section shall pay the license fee plus a fine of not less than $500 but no more than $5,000 plus court costs.
