There shall be a Board of Health in the Township of Montague consisting of all members of the Township Committee, the Township Tax Assessor and a physician to be appointed by the Township Committee.

The Township Committee shall appoint the physician for a term of three years from the time of his appointment until a successor is appointed as provided for under N.J.S.A. 26:3-9.
A. 
The Board of Health shall adopt bylaws governing its operation. The Mayor shall serve as the Chairperson and the Deputy Mayor shall serve as the Vice-Chairperson. The Board shall have the power and authority to employ a secretary, experts and a staff for enforcing and carrying out its purposes, including a sanitarian and other personnel as provided by law, and to pay for their services and such other expenses as may be necessary and proper, not to exceed any and all amounts appropriated for the use of the Board of Health.

B. 
The Board of Health shall have the powers and perform the duties prescribed by law and also by municipal ordinance. It shall be the duty of the Board of Health to enforce all ordinances of the township which relate to public health and public health nuisances.
C. 
The Board of Health shall make all necessary rules and regulations for the protection of the health of the inhabitants of the township and to guard against the spread of contagious diseases and to prevent by necessary rules the introduction of diseases, contagious or otherwise.
The powers and duties of the Board of Health shall be coextensive with the limits of the township.

The Board of Health shall hold at least four regular meetings, that is to say, quarter-annually each year. Special meetings may be called by the Chairperson or as provided by law.
The appointees, agents and officers of the Board of Health shall hold their offices during the term for which they are severally appointed and shall not be removed except for cause and after an opportunity has been given them for a hearing.
A. 
The Board shall not appoint any person as Health Officer, public health laboratory technician, sanitary inspector, food and drug inspector, milk inspector, meat inspector or plumbing inspector nor employ a person to do work ordinarily performed by them who is not the holder of a proper license as such.
B. 
A sanitary and plumbing inspector holding a license of the second degree may be eligible to appointment as such inspector.
