As used in this chapter, the following terms shall have the meanings indicated:
HANDICAPPED PERSON
Shall include any person who has lost the use of one or more limbs as a consequence of paralysis, amputation or other permanent disability or who is permanently disabled as to be unable to ambulate without the aid of an assisting device or whose mobility is otherwise limited as certified by a physician with a plenary license to practice medicine and surgery in this state or a bordering state.
OFFICE BUILDING AND SHOPPING CENTER
A building or structure of more than 1,500 square feet of gross floor area wherein a commercial or business activity or service is performed or a profession is practiced or wherein any combination thereof is performed in all or the majority of such building or structure.
PUBLIC BUILDING
Shall include any building, structure, facility or complex used by the general public, including but not limited to theaters, concert halls, auditoriums, museums, schools, libraries, recreation facilities, office buildings or shopping centers constructed by any state, county or municipal government agency or instrumentality or any private individual, partnership, association or corporation.
The parking spaces for the handicapped as identified in accordance with § 40-3 are hereby established as restricted parking spaces for the use of handicapped persons who have been issued handicapped person identification cards by the Division of Motor Vehicles pursuant to N.J.S.A. 39:4-205, when using a motor vehicle on which is displayed a placard issued pursuant to N.J.S.A. 39:4-206.
Parking spaces in front of public buildings shall be identified by the Superintendent of the Road Department in accordance with the following guidelines:
A. 
A minimum of 1% of the total number of parking spaces, but not less than one parking space, shall be provided in an area of the parking facility which is most accessible and approximate to the building or buildings which the facility serves.
B. 
Each space or group of spaces shall be identified with a clearly visible sign displaying the international symbol of access along with the following wording: "These spaces reserved for physically handicapped drivers."
C. 
Each space shall be 12 feet wide to allow room for persons in wheelchairs or on braces or crutches to get in and out of either side of an automobile onto a level, paved surface suitable for wheeling and walking.
D. 
Where possible, such spaces shall be located so that persons in wheelchairs or using braces or crutches are not compelled to wheel or walk behind parked cars.
No owner or operator other than as set forth in § 40-2 shall stand or park a vehicle in any restricted parking space established and identified under the provisions of this chapter.

Unless another penalty is expressly provided by New Jersey Statute, a person convicted of a violation of this chapter or any supplement thereto shall be liable to a fine of $100 for the first offense and, for subsequent offenses, a fine of at least $100 and up to 90 days community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.
