Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c.383),[1] the New Jersey Uniform Fire Code shall be locally enforced in the Township of West Deptford with the guidance and assistance of the West Deptford Township Fire Official.

The local enforcing agency shall be the Bureau of Fire Prevention, which is created within the Department of Inspections with the guidance of the West Deptford Fire Chiefs' Association.

The Bureau of Fire Prevention shall enforce the Uniform Fire Safety Act[1] and the codes and regulations adopted under it and all buildings, structures and premises within the boundaries of the Township of West Deptford and shall faithfully comply with the requirements of the Uniform Fire Safety Act and Uniform Fire Code (N.J.A.C. 5:70 et seq.).
The Fire Official shall attend and submit a monthly progress report to the West Deptford Chiefs' Association.

The Bureau of Fire Prevention as the enforcing agency shall carry out periodic inspections of life hazard uses as required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs of the State of New Jersey.

The local enforcing agency, the Bureau of Fire Prevention, shall be a part of the Department of Inspections of the Township of West Deptford and with regard to hours, vacation time and other administrative functions, shall be under the direct supervision of the Township Administrator.
A. 
Appointment of Fire Official. The Bureau of Fire Prevention shall be under the supervision of a Fire Official who shall be appointed by the Township Committee of West Deptford. The Township Committee may consider the recommendations submitted to the Township Committee from the West Deptford Fire Chief's Association for the Fire Official appointment.

B. 
Term of office. The Fire Official shall serve for a term of two years. Any vacancy shall be filled for the unexpired term by the Township Committee as set forth in Subsection A.

C. 
Inspectors and employees. Additional inspectors and other employees that may be necessary in the local enforcing agency shall be appointed by the Township Committee of West Deptford as in the same manner as in Subsection A.
D. 
Removal from office. The Fire Official, inspectors and other employees of the local enforcing agency shall be responsible for enforcing the code and shall be subject to removal for inefficiency or misconduct by the Township Committee of the Township of West Deptford. The Township Committee shall look to the West Deptford Fire Chiefs' Association for specific items of inefficiency and misconduct and failure to enforce the code and carry out the required duties of filing reports and other requirements required by the State of New Jersey and Township of West Deptford. The Fire Official or employees to be so removed shall be afforded an opportunity to be heard by the Township Committee of the Township of West Deptford.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,[1] any person aggrieved by any order of the local enforcing agency shall have the right to appeal to the Construction Board of Appeals of the County of Gloucester.

In addition to the inspections and fees required pursuant to this Act and the regulations of the Department of Community Affairs, the following additional inspections and fees shall be required as listed below.[1]

The State permit fees as established in N.J.A.C. 5:70-2.9(c) shall apply.

Any person violating the provisions of this Article and/or the State Fire Code shall be subject to the penalties enacted for the New Jersey State Fire Code and also may be subject to fines as set forth in Chapter 11 and/or 30 days in the county jail, and the Fire Official is hereby given the power, along with the Code Enforcement Officer in the Township of West Deptford, to close down any building not in compliance with the Fire Code and to withhold any required permits, such as but not limited to the certificate of occupancy.
