All applications for development filed prior to the effective date of this chapter may be continued, but any appeals arising out of decisions made on any such application shall be governed by the provisions of this chapter.
A. 
Any owner or agent, and any person or corporation who shall violate any of the provisions of this chapter, or fails to comply herewith with any of the requirements hereof, or who shall erect, structurally alter, enlarge, rebuild or move any building or buildings, or any structure, or who shall put into use any lot or land in violation of any detailed statement or plan submitted hereunder, or who shall refuse reasonable opportunity to inspect any premises, or who shall subdivide or re-subdivide any lot, tract or parcel of land, shall be liable to a fine of not more than $1,000, or imprisonment for any term not exceeding 90 days, or community service for a term not exceeding 90 days, or any combination thereof. Each and every day such violation continues shall be deemed a separate and distinct offense.
B. 
The owner of any building or structure, lot or land, or part thereof, when a violation of this chapter takes place or shall exist, and any architect, building contractor, agent, person or corporation employed in connection therewith and who assists in the commission of such violation shall each be guilty of a separate offense and upon conviction thereof shall each be liable to the fine or imprisonment, or both, as specified in § 72-902.
A. 
Severability. If any article, section, subsection, sentence, clause or phrase of this chapter is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this chapter.
B. 
Continuity of regulation and repeal of conflicting ordinances.
(1) 
Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms of this chapter are hereby repealed to the extent of such conflict or inconsistency, provided however, that the adoption of this chapter shall not prevent or bar the continuance or institution of any proceedings for offenses heretofore committed or violations heretofore occurring in violation of any existing ordinances of the Borough of Wenonah.
(2) 
This chapter is an amendment of the existing Land Subdivision Ordinance, Zoning Ordinance and all other land use ordinances, and shall re-establish and continue the various boards and municipal agencies. Any prior violation of the repealed ordinances shall not be waived by the adoption of this chapter, unless by the terms hereof such violations shall ceased to exist.
(3) 
This chapter shall be incorporated into the Code of the Borough of Wenonah, county of Gloucester, State of New Jersey.
(4) 
This chapter shall take effect immediately upon its final passage and publication, as required by law.
