A. 
General. Except where specifically defined herein, all words and terms used in this chapter are intended to be construed according to their ordinary and customary meaning. Words used in the present tense shall include the future, words used in the singular number include the plural, and words used in the plural number include the singular, unless the context clearly indicates the contrary.
B. 
Words, phrases and terms.
(1) 
The word "shall" is always mandatory. The word "may" is permissive.
(2) 
The word "building" or "structure" includes any part thereof. The word "lot" includes the word "plot" or "parcel."
(3) 
The phrase "used for" includes "arranged for," "designed for," "maintained for" and "occupied for."
(4) 
The word "person" includes an individual person, a firm, a corporation, a partnership, an association, a company or any other agency of voluntary action or organization of any kind.
(5) 
The term "front" or "face" of a building shall mean the outer surface of a building which is visible from any private or public street or highway.
(6) 
The term "illuminated," with reference to a sign, shall mean any sign illuminated by electricity, gas or other artificial light, including reflective or phosphorescent light.
(7) 
The term "lighting device," with reference to a sign, shall mean any light, string of lights, or group of lights located or arranged so as to cast illumination on a sign.
As used in this chapter, the following terms shall have the meanings indicated:
ACCESSORY BUILDING
Any building detached from, subordinate to, and whose use is customarily incidental to the use of the principal building on the same lot. Such buildings include but are not limited to: garages, carriage houses, boathouses, greenhouses, pool houses, workshops or studios, gazebos, potting sheds, storage sheds, and similar structures. An accessory building shall be deemed detached if it does not share a common wall with the principal building on the same lot.

ACCESSORY SIGN
Any sign related to a business or profession conducted or to a commodity or service sold or offered upon the premises where such sign is located.
ACCESSORY USE
A use customarily incidental and subordinate to a principal use or building and located on the same lot with such principal use or building.
ALTERATION
As applied to a building or structure, a change or rearrangement in the structural parts of such building or structure, or any enlargement thereof, whether by extension on any side or by any increase in height, or the moving of such building or structure from one location to another.
ALTERNATIVE TOWER STRUCTURE
Man-made trees, clock towers, bell steeples, light poles and similar alternative-design mounting structures that camouflage or conceal the presence of antennas or towers.

ANTENNA
Any exterior transmitting or receiving device mounted on a tower, building or structure and used in communications that radiate or capture electromagnetic waves, digital signals, analog signals, radio frequencies (excluding radar signals), wireless telecommunications signals or other communication signals.

ATTIC
That space of a building which is immediately below and wholly or partly within the roof framing. An attic with a finished floor which is sufficient in height or space to provide for human occupancy shall be counted as 1/2 story in determining the permissible number of stories.
AUTOMOBILE SALES, AUTOMOBILE SERVICE AND OTHER AUTOMOTIVE FACILITIES
See "vehicular activity."
BASEMENT
A story not less than six feet in height partially below finished grade but having at least 1/2 of two outside walls or all of one outside wall (measured from floor to ceiling inside of the basement) above finished grade. A basement shall be counted as one story in determining the height of a building in stories. (See "cellar.")
BED-AND-BREAKFAST HOMESTAYS
The use of a single-family dwelling, subordinate and incidental to the principal use of the property as a single-family residence of occupancy by the homeowner(s), made available for compensation to transient guests which meet the following criteria:

A. 
Not more than two sleeping rooms if located in the A2 or C Zoning Districts are made available, and not more than five sleeping rooms, limited to 10 occupants*, if located in the D Zoning District are made available;
B. 
No cooking facilities are available to guests and no prepared foods other than breakfast that may be served by the owner(s) at the owner's option;
C. 
The duration of any such stay shall not exceed seven consecutive nights;
D. 
The single-family dwelling in which such rooms are made available must exist as of the effective date of this definition; and
E. 
The owner(s) must be physically in residence at such dwelling during periods in which the rooms are rented. Short-term absence(s) by the owner(s) during periods in which the rooms are rented are permitted as long as the following are satisfied:
(1) 
The owner must have and demonstrate that on-site supervisory management is present during short-term absence(s); and
(2) 
Short-term absence(s) shall mean for no more than three weeks in any one calendar year.

BERM
A man-made landscape feature generally consisting of a linear mound of soil. Temporary soil stockpiles and retaining walls shall not be considered berms.

BOAT
A watercraft whose length exceeds 15 feet.
BOATHOUSE
A structure to protect boats from the weather.
BUILDING
Any structure which is permanently affixed to the land, has one or more stories and a roof, and is intended for the shelter, housing or enclosure of persons, animals, or chattel.
BUILDING, ACCESSORY
See "accessory building."
BUILDING HEIGHT
See "height of building or structure."
BUILDING LINE
The line formed by the intersection of a vertical plane that coincides with the most projected exterior surface of a building or structure, above or below the ground.
BUILDING, PRINCIPAL
See "principal building."
BULK
A term used to describe the size, volume, area and shape of buildings and structures and the physical relationship of their exterior walls or their location to lot lines, other buildings and structures, or other walls of the same building, and all open spaces required in connection with a building, other structure, or tract of land.
CARE HOME
A structure occupied as a temporary or permanent residence by three or more persons and which is either designed principally for housing for the aged where specific age limits are prescribed by public or private regulatory or administrative agencies, irrespective of the need for custodial care and/or supervision on the premises, or designed for occupancy by persons who, by reason of chronic illness, handicap, age, senility, convalescence or infirmity, are dependent upon varying amounts of custodial care and/or supervision. This term shall include, by way of illustration and not limitation, nursing homes, rest homes, homes for prenatal care, and convalescent homes and shall similarly exclude hospitals, clinics, mental health facilities, and similar institutions devoted primarily to the diagnosis and/or treatment of disease or injury, except where such facilities are accessory to a care home.
CARRIAGE HOUSE
An accessory building which contains or could contain more than one story in excess of six feet in height from floor to ceiling, or any accessory building containing a bathroom. See § 225-23 of this chapter.

CAR WASH, CAR LOT, ETC.

CELLAR
A story partially below finished grade and being less than six feet in height or having less than 1/2 of two outside walls or less than all of one outside wall (measured from floor to ceiling inside) above finished grade. A cellar shall not be counted as a story in determining the height of a building in stories. (See "basement.")
CHURCH
Any building or structure used for worship or religious instruction, including social and administrative rooms accessory thereto.
CLUB, NONPROFIT
An organization catering exclusively to members and their guests or a premises and building used for recreational or athletic purposes which are not conducted primarily for gain, provided that there are not conducted any vending stands, merchandising or commercial activities except as required generally for the membership and purposes of the club.
CLUSTER HOUSING
See § 225-33 of this chapter.

CODE ENFORCEMENT OFFICER

COMMERCIAL USE
A use enumerated in the Permitted Use Chart at the end of this chapter or any other use primarily intended for gain.
COMMERCIAL VEHICLE
A vehicle of more than one ton capacity used for the transportation of persons or goods primarily for gain or a vehicle of any capacity carrying a permanently affixed sign exceeding one square foot in area or lettering of a commercial nature.
CONDOMINIUM
A multifamily dwelling, the dwelling units of which are individually owned, with each owner receiving a deed enabling him to sell, mortgage, or exchange his dwelling unit independent of the owners of the other dwelling units in the multifamily dwelling.[1]
CORNER LOT
A lot situated on two streets at their intersection. The front yard is designated as the yard in front of the main entrance.

CRITICAL IMPACT
One or more characteristics of a land use activity enumerated in § 225-52A of this chapter.
CRITICAL IMPACT USE
See § 225-52A of this chapter.
DAY NURSERY
A place for the care of three or more children away from their homes who stay for a period of three hours or more but less than 24 hours, irrespective of compensation, reward or otherwise.
DISTRICT
A land use control district.
DISTRICT, MORE RESTRICTED AND LESS RESTRICTED
In the following list, each district shall be deemed to be more restricted than the districts which follow it: A, B, C and D.

DOCK
A structure projecting from or along the shore into the water of Skaneateles Lake and including piers and wharfs used as a berthing place for boats to load or unload.
DRIVE-IN WINDOW OR OTHER DRIVE-IN FACILITY
See "vehicular activity."
DWELLING
Any building or structure, or part thereof, used and occupied for human habitation or intended to be so used. The terms "dwelling," "dwelling unit," "one-family dwelling," "two-family dwelling," "multifamily dwelling" and "townhouse dwelling" shall not be deemed to include motel, hotel, rooming house or other accommodations used for more or less transient occupancy of less than 30 days.[3]

DWELLING, DETACHED
A dwelling having no party wall in common with another building.
DWELLING, MULTIFAMILY
One or more dwellings located on a single lot or on contiguous lots with common ownership providing separate dwelling units for three or more families, including condominiums and cooperative apartment buildings.
DWELLING, ONE-FAMILY
A detached dwelling containing one dwelling unit and designed or used exclusively for occupancy by one family.
DWELLING, TOWNHOUSE
A dwelling containing one dwelling unit and designed or used exclusively for occupancy by one family, one or two of whose walls are party walls with adjoining dwellings.
DWELLING, TWO-FAMILY
See § 225-24A of this chapter.
DWELLING UNIT
One or more rooms located within a dwelling and providing complete living accommodations for one family, including cooking and bathroom facilities. See also "mobile home."
ERECT
With reference to any sign, shall mean to build, construct, alter, repair, display, relocate, attach, hang, place, suspend, affix or maintain any sign and shall also include the painting of exterior wall signs.
FAMILY
One or more persons related by blood, marriage or adoption, living and cooking together, exclusive of household servants. A number of persons living together as a single housekeeping unit although not related by blood, adoption or marriage shall be deemed to constitute a family unit. A fraternity or sorority house or rooming house shall not be considered a family. [4]
FINISHED GRADE
The elevation at which the finished surface of the surrounding lot intersects the walls or supports of a building or structure. If the line of intersection is not reasonably horizontal, the finished grade, for purposes of computing the height of buildings and structures or for other purposes, shall be the average elevation of all finished grade elevations around the periphery of the building.
FLOODWAY PERMIT
See Article VI of this chapter.
FLOOR AREA
The aggregate sum of the gross horizontal areas of the several stories of a building, measured from the exterior walls of the building or from the center line of any party walls of the building. (See "minimum livable floor area.")
FRONTAGE
A front lot line which is coincident with a right-of-way line of a public street.
FRONT YARD
See "yard, front."
FUNERAL HOME
A dwelling or other structure used and occupied by a professional licensed mortician for burial preparation and funeral services, but expressly excluding morgues and educational facilities engaged in teaching mortuary science.
GARAGE
A single-story building designed and utilized principally for the parking of vehicles and limited storage of household items; provided, however, that no garage accessory to a residential use shall be used for the storage of any vehicle other than not more than three automobiles without a special use permit for such storage of such other vehicles having been issued by the Zoning Board of Appeals. Garages shall not be used for human habitation or contain cooking or bathroom facilities.

GASOLINE SERVICE STATION
An area of land, including structures thereon or any building or part thereof, that is used for the sale and direct delivery of gasoline or any other motor vehicle fuel or oil and lubricating substances. (See also "vehicular activity.")
GRADE, FINISHED
See "finished grade."
HEIGHT OF BUILDING OR STRUCTURE
The vertical distance measured from the lowest grade point along the wall of a building or adjacent to the side of a structure to the highest point of such building or structure.

HOME OCCUPATION

HOTEL
A building or group of buildings on a single lot which contain(s) as its only principal use living and sleeping accommodations for transient occupancy containing six or more rental units (rooms) with on-site supervisory management at all times, and which has a common exterior entrance or entrances, and which may contain one or more facilities incidental to such occupancy, such as dining rooms, gift shops, personal services, a bar where nonalcoholic and alcoholic beverages may be served for on-premises consumption, restaurants, meeting rooms, lounges, swimming pools and related incidental uses designed primarily to accommodate the occupants thereof but which may also be open to the general public. Retail is permitted in a hotel as an accessory use at street level.

JUNKYARD
A lot or a building or structure, or any part thereof, used primarily for the collecting, storage or sale of wastepaper, rags, scrap metal, discarded appliances or other similar scrap or discarded material or for the collecting, dismantling, storage and salvaging of machinery or vehicles not licensed and not in running condition, and for the sale of parts thereof, including an auto salvage yard.
LAKE LINE
The line at the City of Syracuse datum plane of 863.27 feet. (The corresponding National Geodetic Vertical Datum level of 1929 is 865.02 feet.)

LAKESHORE SETBACK ZONE
The area of any lot located between the side lot lines, the lake line, and a line located 50 feet onshore from the lake line.

LAND USE ACTIVITY
The purpose for which any building or other structure or land or part thereof is arranged, designed, intended, maintained, used or occupied, and any occupation, business activity or operation conducted or intended to be conducted in or on any such building or other structure or land or part thereof (including surface, subsurface and air space).
LAND USE CONTROL DISTRICT
See § 225-5 of this chapter.
LIGHT MANUFACTURING
A commercial use characterized by the transformation of substances into new products, including assembly of component parts of other manufactured products, with or without use of power-driven machinery and materials-handling equipment and storage and transportation facilities related to such products.

LODGING
A building or group of buildings, whether detached or in connected units, on a single lot, containing individual sleeping units intended primarily for transient travelers, containing six or more rental units (rooms) with on-site supervisory management at all times. Accommodations incidental to such occupancy may be provided, including dining rooms, gift shops, personal services, a bar where nonalcoholic and alcoholic beverages may be served for on-premises consumption, meeting rooms, lounges, swimming pools and physical fitness rooms, to accommodate the residents and invited guests and the general public.

LOT
An area of land contained within lot lines shown on a properly recorded subdivision map or similar document approved pursuant to this chapter or any previous zoning or subdivision code, ordinance, local law, rule or regulation of the Village or described in a deed recorded prior to March 10, 1969, and approved as a lot by any applicable regulation. Areas shown on maps or described in deeds which are contiguous shall be considered separate lots unless otherwise indicated or intended as one lot in said instrument.
LOT AREA
An area of land, the size of which is determined by the limits of the lot lines bounding said area and which is usually expressed in terms of square feet. The lot area shall not include any area within the right-of-way line of a dedicated street or the paved area of any private street.
LOT FRONTAGE
See "frontage."
LOT LINE
A boundary defining ownership of land as derived from maps, deeds and similar title documents. Boundaries defining less than a fee interest, including leasehold interests, and common areas shall be submitted to the Code Enforcement Officer for a determination as to whether such boundaries constitute a lot line for purposes of allowing land use activities. Lot lines shall also be classified as rear, front and side lot lines as hereinafter defined. Where the application of such classifications cannot be made with certainty as determined by the Code Enforcement Officer, the Zoning Board of Appeals shall render a determination establishing an appropriate classification for purposes of allowing land use activities.
LOT LINE, FRONT
A lot line coincidental with the line of a street, sidewalk or other public or private right-of-way, except that where such line is described as being within the boundaries of a public or private right-of-way, then the most interior boundary of such right-of-way shall be construed to be the front lot line. Where two public rights-of-way intersect, a lot line coincidental with the boundary line of either may be selected as the front line for development purposes.
LOT LINE, REAR
A lot line generally parallel to or directly opposite a front lot line.
LOT LINE, SIDE
A lot line extending between a front and rear lot line.
LOT, NONCONFORMING
See "nonconforming building, structure or lot."
LOT WIDTH
The linear dimension of a straight line situated between side lot lines of a lot.
MARINE RAILWAY
An immovable structure which may be wholly or partially submerged and constructed of parallel rails attached to cross-ties which support a cradle to launch or haul a boat into or from Skaneateles Lake.
MINIMUM LIVABLE FLOOR AREA
The sum of the floor area contained within and devoted to a single dwelling unit, measured from the faces of exterior walls. The minimum livable floor area includes enclosed porches and balconies and excludes the following:
A. 
Basements and cellars.
B. 
Areas in multifamily dwellings which are used in common by several families, such as stairways, halls, lobbies, elevator shafts, recreation rooms, and areas used for major mechanical equipment.
C. 
Terraces, patios, porches or balconies which are not covered.
D. 
Garages and carports.
MOBILE HOME
A dwelling unit structurally designed for or adaptable to quick mobility or portability, completely manufactured and assembled off site for transportation to a location providing facilities for connection to utilities and sanitary facilities, as distinguished from travel trailers and immobile prefabricated modular units used in residential construction. A mobile home may contain parts that may be folded, collapsed or telescoped when being moved and expanded later to provide additional cubic capacity as well as two or more separately movable components designed to be joined into one integral unit capable of being again separated into the components for repeated movement, and the combination of two or more of such units or expansion of one such unit via folding, collapsing or telescoping devices shall not change the character of said dwelling unit as a mobile home.
MOBILE HOME PARK
A parcel or parcels of land under single ownership, or contiguous privately owned parcels, which are designed, improved or used for the accommodation of two or more mobile homes for a residential use.
MOTEL
A building or group of buildings, whether detached or in connected units, used as individual sleeping units designed primarily for transient automobile travelers, each which sleeping unit is provided with a separate off-street parking space and a separate exterior entrance, together with any incidental uses permitted for a hotel.
MULTIFAMILY DWELLING
See "dwelling, multifamily."
NONACCESSORY SIGN
Any sign unrelated to a business or profession conducted, or to a commodity or service sold or offered, upon the premises where such sign is located.
NONCONFORMING BUILDING, STRUCTURE OR LOT
That part of a building, structure or lot which does not conform to one or more of the applicable bulk regulations of this chapter, either following its effective date or as a result of any subsequent amendments thereto.
NONCONFORMING USE
Any use of a building, structure or lot which does not conform to the use regulations for the district in which such use is located, whether at the effective date of this chapter or as a result of subsequent amendments thereto.
NONPROFIT CLUB
See "club, nonprofit."
NURSING HOME
See "care home."
ONE-FAMILY DWELLING
See "dwelling, one-family."
ON-SITE SUPERVISORY MANAGEMENT
The providing of on-site supervision and management at all times of all aspects of operation of a hotel or lodging or bed-and-breakfast homestay, as appropriate, to a quality and standard commensurate with the community character by either:

A. 
Persons employed by the owner who are not resident at the facility and who possess the training and skill or with equivalent practical experience in hotel or bed-and-breakfast homestay management, as appropriate; or
B. 
Where authorized as provided in § 225-69.1, a professional hotel or lodging management company.
OPEN SPACE
That part of the lot area which is not occupied by buildings, structures, or off-street parking spaces or loading berths. Open space may include lawns, trees, shrubbery, garden areas and paved surfaces which are used as access drives but which are not used for vehicular parking of any kind.
OPEN SPACE SUBDIVISION PLAT
See § 225-33A of this chapter.
PARKING SPACE
An off-street space available for parking one automobile which conforms to the requirements of § 225-58B of this chapter.
PARTY WALL
A wall which is shared by and divides two adjoining buildings, in which each of the owners of the adjoining buildings has rights of enjoyment.
PERMANENT DOCK
A fixed structure projecting from or along the shore into the water of Skaneateles Lake that remains in the lake for more than eight months of the year, including docks and piers used as berthing places for boats.

PIER

PLANNING BOARD
The Planning Board of the Village, duly established and appointed as provided in the Village Law.
PREMISES
Land and all buildings and structures thereon.
PRINCIPAL BUILDING
A building or structure in which is conducted the principal use of the lot on which said building or structure is situated.
PRINCIPAL USE
A use which may be carried on independently of any other use and which generally characterizes the primary purpose for which land or the principal buildings or structures thereon are intended and designed, including all activities enumerated in the Permitted Use Chart at the end of this chapter, excepting those enumerated in Subsection B, Accessory Uses, thereof.
PROFESSIONAL HOTEL OR LODGING MANAGEMENT COMPANY
A company that has as its principal business the supervision and management of hotel or lodging facilities and whose employees have the requisite training and experience to operate said facilities to the same standard of care and quality required of on-site supervisory management.

PROJECTING SIGN
Any sign which projects from the exterior of any building over any sidewalk, street or highway.
RAMP, WHEELCHAIR
A ramp employed to facilitate the movement of a disabled person riding in a wheelchair into and out of a building.
REAR LOT LINE

REAR YARD
See "yard, rear."
RESIDENTIAL USES
Any of the uses enumerated in Subsection A of the Permitted Use Chart at the end of this chapter.

REST HOME
See "care home."
RESTAURANT, VEHICULAR-ORIENTED
A building or structure or portion thereof wherein food products are prepared or packaged and sold on premises directly to the consumer primarily for consumption off the premises or within a parking area on the premises and which building or structure is designed or advertised primarily for such purposes, as distinguished from restaurants designed and utilized primarily for on-premises consumption or retail food establishments such as food and fish markets, bakeries and butcher shops. (See "vehicular activity" and "restaurant.")
RESTAURANT WITHOUT VEHICULAR-ORIENTED OR DRIVE-THROUGH SERVICE
A building or portion of a building where food and beverages, both nonalcoholic and alcoholic, are sold to the public for consumption on the premises. Such use may also provide entertainment on the premises.

RETAIL SALES SERVING HOTEL OR MOTEL OR LODGING
The sale of merchandise to serve the needs of the transient residents and invited guests of the hotel or motel or lodging use. Such accessory use shall be limited to a single area not to exceed 500 square feet within the hotel or motel or lodging use.

ROOMING HOUSE
A dwelling in which one or more rooming units are offered for rent with or without meals.
ROOMING UNIT
A room or rooms used to provide private living and sleeping quarters but which does not contain cooking facilities.
SETBACK
The distance in feet from the street line or any lot line to the building line of any building or structure located on the lot.

SEXUALLY ORIENTED BUSINESS

A. 
ADULT BOOKSTOREAn establishment having as a substantial or significant portion of its stock-in-trade devices, books, magazines and other periodicals which are distinguished by or relate to specified sexual activities or specified anatomical areas, as defined below, or an establishment with a segment or section devoted to the sale or display of such material.
B. 
ADULT MOTION PICTURE THEATERA building used for presenting material distinguished or characterized by an emphasis on matter depicting, describing or relating to specified sexual activities or specified anatomical areas as defined below for observation by persons therein.

An outdoor dining area located adjacent to a public sidewalk and/or on private property which provides food and/or beverages and contains readily removable tables, chairs, railings, planters or similar furnishings or structures. It shall be otherwise unenclosed by fixed walls and open to the air.

SPECIAL USE PERMIT
An authorization for a particular land use which is permitted in this chapter, subject to conditions imposed by the Zoning Board of Appeals and the prescribed standards of this chapter to assure that the proposed use is in harmony with this chapter and will not adversely affect the neighborhood if such conditions are met.
SPECIFIED ANATOMICAL AREAS
A. 
Less than completely and opaquely covered human genitals, pubic region, buttocks and female breast below a point immediately above the areola; or
B. 
Human male genitals in a discernibly turgid state, even if completely and opaquely covered.

SPECIFIED SEXUAL ACTIVITIES
A. 
Human genitals in a state of sexual stimulation or arousal;
B. 
Acts of human masturbation, sexual intercourse or sodomy; or

Anything constructed or erected, the use of which requires location on the ground or attachment to something having a location on the ground.

TOWER
Any structure that is designed and constructed primarily for the purpose of supporting one or more antennas for telephone, radio and similar communication purposes, including self-supporting lattice towers, guyed towers, or monopole towers. The term includes radio and television transmission towers, microwave towers, common-carrier towers, cellular telephone towers, alternative tower structures and structures used to support the related equipment. The term includes the structure and any support thereto.

TRANSIENT OCCUPANCY
Living and/or sleeping accommodation provided for compensation or barter for a period of less than 30 consecutive days. Bed-and-breakfast homestays, hotels, and lodging shall individually and collectively be transient occupancies.

TRAVEL TRAILER
A vehicular portable structure built on a chassis designed to be used primarily as a temporary dwelling for travel, recreational and vacation uses, having a body width not exceeding eight feet and a body length not exceeding 32 feet.

VARIANCE

Refers collectively to the categories hereinafter set forth and defined:

VEHICULAR SERVICEThe on-premises repair, maintenance, improvement and general servicing of self-propelled vehicles, including gasoline service stations, car wash facilities, body and fender shops, self-service gas pumps and any and all types of similar facilities, whether automatic or attendant managed.
B. 
VEHICULAR SALESThe sale and/or leasing of used and/or new self-propelled vehicles, including automobile showrooms and used car lots.
C. 
VEHICULAR TRANSITPublic, quasi-public and private commercial or nonprofit vehicular transportation facilities, including mass transit carriers, taxi companies, private institutional or industrial carriers, bus depots, train stations, taxi parking and dispatching facilities, aircraft facilities such as heliports, airports, and commercial landing fields, and similar facilities and installations.
D. 
VEHICULAR PARKINGA principal use of premises as a commercial parking facility for vehicles open to the general public, including parking garages and lots.
E. 
VEHICULAR PARKING LEASED TO SERVE OTHER USESAn accessory use of premises as a parking facility for vehicles to serve other uses and open to the general public from May 1 to September 30.

F. 
VEHICULAR-ORIENTED CONSUMER SERVICESFacilities designed to provide consumer services on premises to persons remaining within vehicles, excluding vehicular service but including drive-in-type services associated with restaurants, banks, and related facilities having a drive-in window and/or permitting on-premises food consumption within a vehicle, and also including drive-in theaters.

YARD, FRONT
A yard extending across the full width of the lot and lying between the street right-of-way and the nearest point of the building.
YARD, REAR
A yard extending across the full width of the lot and lying between the rear lot line of the lot and the nearest point of the building.
YARD, REQUIRED
That portion of the open area of a lot extending open and unobstructed from the ground upward along a lot line for a depth or width as specified by the bulk regulations of the district in which the lot is located. No part of such yard shall be included as part of a yard or other open space similarly required for buildings on another lot.
YARD, SIDE
A yard situated between the building and the side line of a lot and extending from the front yard rear line (or from the front lot line, if there is no required front yard) to the rear yard front line (or rear lot line).
