The Town of Shelter Island is unique, completely surrounded by water and located between the North and South Forks of Long Island, Suffolk County, New York, having vehicular transportation links to the mainland only by ferry boats, the service of which is not available 24 hours per day and has been interrupted by storms and inclement weather. It is the intent of this legislation to provide the public with prompt, efficient service by its employees, as needed, 24 hours per day by requiring that said employees be residents of the Town of Shelter Island.
Every employee of the Town of Shelter Island shall, throughout the term of his or her employment, be a full-time resident of the Town of Shelter Island.
The following types of personnel shall be exempt from the residency requirement of this legislation:
A. 
Professional personnel such as attorneys, accountants, engineers, surveyors, land use planners, economists, physicians, nurses and the like.
B. 
Personnel incidental to independent contractors.
C. 
Personnel incidental to purchases and public works contracts subject to bid pursuant to the New York General Municipal Law § 103.
D. 
Personnel incidental to purchases and/or leases.
E. 
Part-time policemen.

F. 
In case of need as determined by resolution of the Town Board, nonresident full-time policemen may be employed, provided that within one year from the date of employment, such nonresident policemen are full-time residents of one of the five east-end towns. All nonresident policemen are strongly encouraged to become residents of the Town of Shelter Island.

G. 
Clerical positions employees must be residents when hired, but may seek permission from the Town Board to relocate off-island after three years of satisfactory performance in cases of need.

H. 
Part-time employees, but only if first priority for hiring is given to qualified residents.
