A. 
Unless otherwise expressly provided, the singular shall include the plural, the masculine the feminine.
B. 
As used in this article, the following terms shall have the meanings indicated:
AUCTIONEER
A person who cries off and sells real or personal property at public auction, excepting a person or officer making sale of real or personal property in pursuance of an execution on order of a court of competent jurisdiction.
HAWKER
A person who, in a public street or place, cries forth the goods, wares and merchandise which he has to sell.
ITINERANT VENDOR
A person who, having no regular place of business within the Borough, brings merchandise, medicines or remedies into the Borough to be sold in the streets or public places.
PEDDLER
A person who travels from house to house with goods, wares or merchandise for the purpose of selling the same. The term does not include a person peddling the product of a farm owned by him situated in this state.
PERSON
An individual, firm, partnership, corporation, voluntary association or an incorporated association.
SOLICITOR
A person who travels from house to house for the purpose of selling or soliciting orders or subscriptions for the sale of books, magazines, papers, goods, wares or merchandise.
A. 
No person shall hereafter carry on or conduct or engage in the calling, occupation or business of an auctioneer, a hawker, a peddler, a junk dealer, a rag dealer, a solicitor or an itinerant vendor of merchandise, medicines or remedies unless he shall have first procured a license as herein provided and shall at all times when engaged in such business or occupation have such license upon his person or conspicuously displayed upon any vehicle or stand which he may use in connection with such business or occupation.
B. 
No person shall conduct any show, carnival or circus within the Borough without a license issued under the provisions of this article; provided, however, that no license shall be required for any show, carnival or circus given by and for the benefit of a religious, charitable, social or fraternal organization or association.
C. 
The licenses herein required shall be issued by the Chief of Police upon the presentation of a proper application therefor and the payment of the fee herein fixed, which fee shall be for the use of the Borough.
D. 
All applications for a license shall be made in writing and filed with the Chief of Police. The application shall state the name of the applicant, his address, the nature of the license desired and such other facts as the Chief of Police may require. The Chief of Police shall keep a record of all licenses issued by him, which record shall show the date of the issuance, the number of the license, the character of the license, the name and address of the person licensed and the amount of the fee paid. The Chief of Police shall remit all moneys received by him for license fees as herein provided to the Borough Collector on or before the first day of each month and shall also make a written report to the Mayor and Council for each calendar month, setting forth the number of each kind of licenses issued and the amount collected and remitted to the Borough Collector. Applicants shall be fingerprinted by the Chief of Police, and all applications shall be made at least five days before the effective date of the license.
E. 
The licenses issued hereunder shall be of three kinds, to wit: an annual license, semiannual license and monthly license. An annual license is a license which will remain in force continuously until the first day of January next succeeding its issue, unless previously revoked as herein provided. A semiannual license is a license which will remain in force continuously for a period of not longer than six months from the date of its issuance. A monthly license is a license which will remain in force continuously for a period of one month from the date of its issuance.
F. 
The forms of licenses and applications therefor shall be prepared and furnished by the Mayor and Council. All licenses shall be numbered consecutively. Annual licenses shall bear, in addition to the serial number, the letter "A"; semiannual licenses shall bear, in addition to the serial number, the letters "SA"; monthly licenses shall bear, in addition to the serial number, the letter "M." It shall be the duty of the Borough Clerk to keep a record of all license blanks issued to the Chief of Police and to verify the accounts and reports of such officer at least once in each three months. The Chief of Police shall issue, with each license, a badge or button, numbered and bearing the name of the Borough and the word "Solicitor" or other suitable inscription. Upon the issuing of the badge, a deposit of $2 shall be collected as security for the return thereof at the expiration of said license. The licensee to whom such badge is issued shall secure and wear the same conspicuously upon his person at all times.
G. 
No license granted hereunder shall be transferable, and no license shall apply to any person other than the one named therein.
H. 
Every person engaged in an occupation or business for which a license is required by the provisions of this article shall exhibit such license at any time upon the request of a member of the Police Department or any other person. All badges provided by this article shall be worn upon the outer garment of the person holding the same so that the same shall be visible to all observers. He shall pick up his badge and return the same daily, between 8:00 a.m. and 6:00 p.m., and shall not pursue his calling after dark.
I. 
Any license granted under the provisions of this article may be revoked by the Chief of Police, after a hearing, for the violation of any of the provisions of this article or any other ordinance of the Borough applicable to such licensee or his occupation or business. In case of such revocation, the applicant may appeal to the Mayor and Council, whereupon opportunity will be granted for hearing reasons for and against the revocation of such permit. The decision of the Mayor and Council shall be final.
J. 
No license granted in pursuance of this article shall create any vested rights, or grant any privileges, other than the privilege of conducting such business or occupation in accordance with the statute of this state, this article and any other ordinance of the Borough.
K. 
No person holding a license as a hawker, solicitor, peddler or itinerant vendor shall remain in any one place for the purpose of conducting such business or occupation for more than 15 minutes at any one time unless he shall have procured a license from the Chief of Police to conduct such business or occupation at such location, which location must be stated in such license. The Chief of Police is hereby authorized to refuse to issue a license for the conducting of any business or occupation at a stand or at a location which in his opinion will cause congestion or interfere with the use of the streets and public places.
L. 
The license fees herein imposed are imposed for the purpose of revenue.
M. 
No person shall engage in any of the activities described in Subsections A and B hereof at any function conducted by the Borough of Ridgefield or any of its agencies, subsidiaries and commissions, and the issuance of a license pursuant hereto shall not be construed as granting such permission at such Borough or Borough-related functions.

The fees for licenses herein provided for shall be as follows, to wit:
A. 
An auctioneer: for an annual license, $100; for a semiannual license, $50; and for a monthly license, $25.
B. 
For a hawker, solicitor, peddler, itinerant vendor of merchandise, medicines or remedies, junk dealer or rag dealer, the fees shall be as follows, to wit:
(1) 
If the business or occupation is to be conducted by traveling without any vehicle or cart: $25 for an annual license; $15 for a semiannual license; and $5 for a monthly license.
(2) 
If the business or occupation is to be conducted by the use of pushcart, or other cart, not propelled by horse or motor power: $40 for an annual license; $25 for a semiannual license; and $15 for a monthly license.
(3) 
If the business or occupation is to be conducted by the use of horse or horses and wagon, or a motorcar or truck, having a capacity of not exceeding one ton: $100 for an annual license; $50 for a semiannual license; and $25 for a monthly license.
(4) 
If the business or occupation is to be conducted by the use of a vehicle having a capacity of exceeding one ton: $200 for an annual license; $100 for a semiannual license; and $50 for a monthly license.
(5) 
If such business or occupation is to be conducted at a stand or fixed location, the fee for an annual license for such location shall be $50; for a semiannual license for such location, $25; and for a monthly license, $10.
C. 
The annual license for a show shall be $100; semiannual license shall be $50; and for a monthly license, $25.
D. 
The annual fee for a license for a carnival shall be $500.
E. 
The license for a circus shall be $100 per day.
This article shall not include the following persons, who are expressly exempt from its application:
A. 
Any person honorably discharged from the military service of the United States possessing a peddler's license issued in conformity with N.J.S.A. 45:24-10.
B. 
Any nonprofit vendor.
C. 
Any person who conducts a sale pursuant to statute or court order.
D. 
Persons selling or soliciting in behalf of local churches, charities, fraternal organizations, philanthropic organizations and municipal organizations.
E. 
Persons selling or soliciting in behalf of national charitable, fraternal, philanthropic or religious organizations.
F. 
Persons selling or soliciting orders for the sale of milk, dairy products, vegetables, poultry, eggs and other farm and garden produce.
G. 
Newsboys selling or soliciting orders for the sale of newspapers.

A. 
If this article of the Code of the Borough of Ridgefield provides for the licensing or permitting of the violator, the Mayor and Council of the Borough of Ridgefield reserve the right to revoke such permit or license.
B. 
Any person found guilty of violating this article of the Code of the Borough of Ridgefield shall be subject to a penalty consisting of a fine or imprisonment, or both, subject to the discretion of the Judge, the maximum of which shall be the maximum fine or term of imprisonment permitted to be imposed by the court having jurisdiction over the violation of this article of the Code of the Borough of Ridgefield; provided, however, that the fine shall not be less than $100 nor more than $2,000 per offense and the prison term shall not exceed 90 days in accordance with N.J.S.A. 40:49-5.
C. 
In the event of a continuing violation, each day shall constitute a separate offense.
