Any person, firm or corporation willfully, maliciously or negligently disturbing, injuring or destroying the paving, material or construction composing any sidewalk, footway, roadway, curbing, gutter, sewer drain, conduit, sewer inlet, sewer or conduit man hole, sewer, lamp hole water stop box, center stone cover, street sign, guide posts or other municipal improvement or construction located in the public streets of the Town of Middletown, Delaware, either by means of fire, the use of implement or machinery, the moving of a traction engine, the building of mortar box or by any other means, shall be considered as having committed a nuisance and upon conviction thereof shall be subject to a fine as provided in § 146-2, besides costs of repairing such damage and the costs of prosecution.

Violations of the provisions of this article shall be punishable by a fine of $25.
