A. 
Any person, firm or corporation advertising for sale, at retail, an article not available for sale during any day of an advertised period shall, on the demand of a purchaser unable to buy the advertised article during the offered period, issue a raincheck which shall be so redeemable as to permit the holder thereof to purchase the advertised article at the advertised price within 30 days of the last original offering date.
B. 
The thirty-day redeemable period may be modified with the consent of both the purchaser and the vendor.
C. 
The raincheck when issued shall specify the following information:

(1) 
The date of issuance of the raincheck.
(2) 
The last date that the raincheck can be redeemed.
(3) 
The name and description of the article.
(4) 
The advertised price.
(5) 
The quantity to be provided.
D. 
Any person, firm or corporation advertising for sale, at retail, an article for sale shall not state within their advertising that a raincheck will not be issued for an advertised article, except where the advertisement clearly states a specific quantity of the article to be sold, and where an article is advertised for sale as limited quantity, then such quantity shall be clearly stated.

E. 
There shall be within each retail establishment a prominently posted sign, poster or placard as to where a raincheek may be obtained by the public pursuant to Subsection A of this section.

F. 
It shall not be made a condition precedent to the issuance of a raincheck that the purchaser prepay the purchase price or any part thereof.

Any person who shall violate any provision of this article shall be guilty of an offense against this article and shall be subject to a fine of not less than $100 nor more than $250 for the first offense, and of not less than $200 nor more than $500 for the second and every subsequent offense.
This article shall be effective throughout the County of Rockland, except that it shall not be effective within the area of any Village or the area of any Town outside of any Village during such time as such Village or Town is regulating the business regulated by the provisions of this article.
