Pursuant to N.J.S.A. 2A:18-61.26, the Rent Leveling Board of the Borough of Middlesex is hereby designated to act as the municipal administrative agency to perform the various tasks which are set forth under the Senior Citizens and Disabled Protected Tenancy Act.[1]

Pursuant to N.J.S.A. 2A:18-61.35, the Middlesex Rent Leveling Board is authorized to levy and collect the following fees, which shall be paid by the owner applying for conversion at the time that the application is filed with the Middlesex Borough Rent Leveling Board. In the event that there are any public hearings required in connection with the conversion of apartment units to condominiums, there shall be an additional fee over and above the basic fees set forth herein of $500 for each public hearing.

The above fee schedule shall be based upon each unit listed for conversion in the application. In the event that one building or structure, as listed on the tax rolls, is converted in stages, the building shall be considered as a single building for determining a fee, without consideration of the number of units listed in the application for conversion. For example, if a building has 25 apartments and the owner applies to the Rent Leveling Board for conversion of 10 of the apartments, the fee shall be based on the number of the apartments in the entire building and not on the number of units which the owner is seeking to convert at that particular time. No expense incurred in the conversion or the maintenance costs shall be passed along to any of the tenants.
The Chairperson or a designee is hereby designated as the administrative officer who shall assume the duties under this chapter and who shall collect the fees prescribed herein.
A copy of this chapter shall be forwarded by the Borough Clerk to the Department of Community Affairs of the State of New Jersey.
