A. 
It shall be unlawful for any person over the age of 18 to assist, aid, abet, allow, permit, suffer or encourage a student to register or enroll in the Middlesex Borough School District where the student is ineligible to attend.
B. 
It shall be unlawful for any person over the age of 18 to knowingly permit his or her name, address or other residence designating documentation to be utilized in the registration or enrollment of any nonresident student in the Middlesex Borough School District.
Any person violating or failing to comply with the provisions of this article shall, upon conviction thereof, be sentenced to make restitution to the Middlesex Borough Board of Education by paying to the Board of Education a penalty equal to the annual tuition cost of any resident together with investigation expenses and reasonable attorneys' fees and to pay a fine of not more than $1,000. Said tuition cost shall be determined in the manner prescribed for nonresident pupils, pursuant to N.J.S.A. 18A:38-19, and the payment of that penalty shall be remitted to the Middlesex Board of Education.
This penalty shall be recovered in a civil action by a summary proceeding in the name of the Borough, pursuant to the Penalty Enforcement Law (N.J.S.A. 2A:58-1 et seq.). The Middlesex Borough Municipal Court and the Superior Court of New Jersey shall have jurisdiction of proceeding for the enforcement of the penalty provided for herein.
Restitution ordered by the Middlesex Borough Municipal Court shall be converted into a lien against the property of the offending party.
