This article shall be known and may be cited as the "Driveway and Road Opening Ordinance of Vernon Township."

A. 
Construction of new driveways or roads. No driveway or road connecting with a street or road which has been accepted as a Township road or is being maintained by the Township or which lies within a subdivision which has received preliminary or final approval from the Township Planning Board shall hereafter be constructed unless a permit shall first be secured from the Township Clerk, or be used unless an approval permit relating to such construction shall be issued by the Township Engineer, certifying that such construction has been satisfactorily completed.
B. 
Alteration and repair of driveways or roads. No driveway or road connecting with a street or road which has been accepted as a Township road or is being maintained by the Township or which lies within a subdivision which has received preliminary or final approval from the Township Planning Board shall hereafter be altered or repaired unless a permit shall have first been secured from the Township Clerk, where such repairs or alterations are to be made to such portions of the driveway or road which lie within and/or 25 feet adjacent to the right-of-way of such Township road or street, or be used unless an approval permit relating to such construction shall be issued by the Township Engineer, certifying that such construction has been satisfactorily completed.

The permit fees for new driveway openings and for reconstruction of driveways are included in Chapter 250, Fees and Escrows, Article II.

The application for the permit shall specify the location of said driveway or road and shall include a detailed plan indicating the proposed grading, paving and drainage construction and such other specifications and details as the Township Engineer may require.

A. 
Any such driveway or road shall be so constructed at its connection with such Township streets or roads that it does not interfere with the flow of water in such street or road, or in any drainage ditches along roads, or in any draining piping or facilities along the road, and shall be constructed to prevent water from draining into the driveway or across such Township street or road.
B. 
That portion of the driveway which lies within the road right-of-way and the next following 25 feet of the driveway adjacent to the road right-of-way shall be constructed of a foundation course of either eight-inch bank-run gravel or four-inch crushed stone, and have a pavement of two inches FABC.
C. 
No certificate of occupancy shall be issued until the driveway is completed or a cash performance guaranty in an amount as determined by the Township Engineer has been posted with the Township. Upon the completion of the driveway, such cash performance guaranty shall be released. In the event such driveways are not completed within six months after issuance of the certificate of occupancy, the performance guaranty shall be utilized to complete such driveways by the Township.
It shall be the duty of the permittee to properly guard the construction by erecting suitable barriers, warning signs and lanterns, and such permittee shall be liable for any neglect to safeguard the traveling public.

Any person violating, or failing to comply with, any of the provisions of this article shall, upon conviction thereof, be subject to the penalties set forth in Chapter 1, Article II, § 1-19, Violations and penalties. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
