This chapter is adopted in order to prevent oil contamination of the soil, surface water and groundwater, thus protecting the health and welfare of Vernon Township residents and preserving and enhancing the quality of the environment.
The New Jersey Department of Environmental Protection has promulgated certain regulations known as the "Used Oil Recycling Regulations," New Jersey Administrative Code 7:26A-6.1 et seq. through and including 3-11.8, which establish standards for the collection, storage, recycling, use and disposal of used oil and shall be controlling unless higher standards are prescribed herein by the Vernon Township Mayor and Township Council.

A. 
As used in this chapter, the following terms shall have the meanings indicated:
OIL RETAILER
Any person who sells to consumers more than 500 gallons of lubricating or other oil annually in containers for use off the retailer premises.
PERSON
Person, persons, partnerships, firms, corporations or other entities.
RECYCLE
To prepare used oil for reuse as a petroleum product or petroleum product substitute by rerefining, reclaiming, reprocessing, or to use used oil in a manner that substitutes for a petroleum product made from new oil.
USED OIL
A petroleum-based or synthetic oil which is used in an internal combustion engine as an engine lubricant, or as a product used for lubricating transmissions, gears or axles, which, through use, storage or handling, has become unsuitable for its original purpose due to the presence of chemical or physical impurities or loss of original properties.
USED OIL COLLECTION AREA
The location on the used oil collection site (private and/or retail) where the used oil is collected, stored or transferred from one container to another.
USED OIL COLLECTION SITE (PRIVATE)
Any site which collects used oil only from their own vehicles into a used oil collection tank.
USED OIL COLLECTION SITE (RETAIL)
Any Motor Vehicle Commission reinspection station, oil retailer, or retail service station, which has a used oil collection tank(s) existing on the premises, or any site which accepts used oil for recycling.
USED OIL COLLECTION TANK
Any tank, drum or other receptacle, whether above or below ground, into which used oil is drained and stored.
B. 
Throughout the text of this chapter, the singular shall constitute the plural and the plural shall constitute the singular unless a contrary definition is expressly provided herein.
A. 
No person shall contaminate the soil, surface water or groundwater of Vernon Township with used oil.
B. 
No person shall store or dispose of used oil except at a used oil collection site. No person shall dispose of more than five gallons of used oil per day to any one used oil collection site.
C. 
Any person handling used oil must use containers free from dirt, debris, antifreeze, water, food products or other substances which would degrade the quality of the used oil.
D. 
No person shall discharge water, antifreeze, industrial waste or any other contaminant into a used oil collection tank.
A. 
All oil retailers shall post and maintain, at or near the point of sale, a durable and legible sign, not less than 11 inches by 15 inches in size, informing the public of the importance of the proper collection and disposal of used oil, how and where used oil may be properly disposed of.
B. 
All operators of used oil collection sites shall post and maintain a durable and legible sign not less than 11 inches by 15 inches in size, easily visible to the public, informing the public that it is a collection site for the disposal of used oil.
A. 
All used oil collection sites (retail) shall accept up to five gallons of used oil per day from any person, unless collection tank or tanks are at capacity. No used oil collection tank or tanks shall remain at capacity for more than five consecutive calendar days. No used oil collection site (retail) shall accept more than five gallons of used oil per day from any person.
B. 
The operator of a used oil collection site (private and/or retail) shall collect used oil in a manner which is safe for users of the site.
C. 
The operator of a used oil collection site (private and/or retail) shall transfer used oil only to a used oil hauler, a used oil recycler, or the operator of a used oil storage facility who complies with the Department of Environmental Protection's special waste manifest system, N.J.A.C. 7:26A-6.1 et seq.
A. 
All used oil collection tanks are to be installed and maintained in a manner which prevents soil and water contamination.
B. 
A cement slab large enough to prevent spillage from contaminating soil or water is required in the area where the waste oil tank is filled and emptied.
C. 
All spillage must be contained and removed as per the New Jersey Department of Environmental Protection regulations.
Draining of used oil shall be done in a manner which prevents spillage, contamination, etc., of surface water, groundwater or soil. This oil must be collected and transported to a used oil collection site as provided by this chapter.

A. 
All existing oil retailers and used oil collection sites (private and/or retail) must register with the Vernon Township Health Officer by July 1, 1988, using the form provided by the Health Officer.
B. 
Any new oil retailers or used oil collection sites must register with the Vernon Township Health Officer within 10 days of commencement of operations.
C. 
Any change, addition, repair, or modification to a used oil collection area must be reported to the Vernon Township Health Officer.
All oil spills which contaminate or may contaminate the soil, surface water, or groundwater must be immediately reported by the person involved in the spill and/or the owner of the effected property to the Vernon Township Department of Health and Human Services or the Vernon Township Police Department.
A. 
All used oil haulers shall comply with the Department of Environmental Protection's special waste manifest system, N.J.A.C. 7:26-7 et seq. Compliance with N.J.A.C. 7:26-7 et seq. shall include the total amount collected, and an itemization of the amounts transferred to other used oil haulers, used oil storage facilities, used oil recyclers, including those facilities not located in the State of New Jersey.
B. 
Used oil haulers shall transfer used oil to other used oil haulers, used oil storage facilities, or used oil recyclers who comply with N.J.A.C. 7:26-7 et seq.
No person may store, dispose of, or transport used oil except as provided by this chapter.

The Health Officer or his representative may inspect an oil retailer or used oil collection site at any time during regular business hours.
Any person violating any provision of this chapter shall, upon conviction thereof, be subject to the penalties set forth in Chapter 1, Article II, § 1-19, Violations and penalties. Each day a violation continues shall constitute a separate offense.

Three copies of this adopted chapter have been placed on file in the office of the Municipal Clerk of Vernon Township and will remain on file in said office for the use and examination of the public.
