Any corporation, company, partnership, association, entity, person or persons, hereinafter known as the "supplier," engaged in the full-time or seasonal supply of potable water to two or more dwelling units in Vernon Township via a system of aqueducts, reservoirs, pumps, well(s), storage tank(s), pipeway(s), control valves and appurtenances, or any combination thereof (hereinafter known as the "system") shall supply potable water to its appropriate customers, and/or dwelling units on a continuing regular basis.

Each supplier shall register with the Vernon Township Health Officer within 90 days of the enactment of this chapter, or within 30 days of transfer and/or change of the nature of ownership of the system(s) once this chapter is in effect.
A. 
The aforementioned registration shall include the name, address and telephone number of the supplier, a thorough description of the system(s), its capacity of storage and delivery, the number of dwelling units currently serviced by the system and the maximum number of dwelling units and/or bedrooms allowed to be serviced by the system.
B. 
The supplier, and/or its agent, shall maintain an emergency service telephone number on a twenty-four-hour-a-day, seven-day-a-week basis. Every customer serviced by the system(s), the Vernon Township Health Officer and the Vernon Township Police Department shall be provided with that emergency service telephone number by the supplier, identifying the system(s) to which it applies.
The supplier(s) shall provide and maintain a system(s) capable of providing at least 600 gallons of potable water per day per dwelling unit serviced by the system(s), or at least 200 gallons of potable water a day per bedroom per dwelling unit serviced by the system, whichever is greater.
The system shall include the watershed, reservoirs, pumps, wells, tanks, pipeways, valves, rights-of-way, power and whatever combination of the above and all other appurtenances that may be required to provide potable water to the dwelling units up to and including any water meters and/or shutoff valves controlling the supply to the dwelling unit.

The supplier shall provide the Vernon Township Health Officer with a certified statement of system capacity, stamped and signed by a professional engineer licensed in the State of New Jersey or a photocopy of a similar document containing the same information on file with the New Jersey Public Utilities Commission, Department of Environmental Protection or any other public entity exercising regulatory control over the system.

A. 
The supplier shall immediately notify the Vernon Township Health Officer of any service interruptions of potable water to one or more dwelling units supplied by the system. In the event the service interruption occurs on a weekend, holiday or time when the Vernon Township Health Officer is closed for business, the supplier shall notify the Vernon Township Police Department.
B. 
The supplier shall notify the Vernon Township Health Officer of any proposed disconnections from, or cessation of service to, any dwelling unit or units connected to the system at least two weeks prior to said disconnection or cessation.
A. 
If a system cannot provide the required volume of potable water specified by this chapter for a continuous period of over 24 hours, the system shall constitute a failing system. In this event, temporary measures on the part of the supplier to provide an emergency water supply to all customers on the systems must be immediately initiated, implemented and maintained during the period the system is deemed failing. Such temporary measures must be approved by the Vernon Township Health Officer, and water provided must be certified potable.

B. 
Every effort must be made on the part of the supplier to reinstate a failing system to its original and/or approved design specifications; however, such conditions shall not exceed 10 days. Failure to fulfill emergency measures shall constitute a violation of this chapter.

A. 
The supplier shall obtain a permit from the Vernon Township Health Officer prior to adding one or more dwelling units to the system. The nature of the addition to the system shall be kept in a file on the system at the Vernon Township Health Officer. The permit issued by the Vernon Township Health Officer shall declare that such an addition is within the certified capacity of the system and that a sealed affidavit by a professional engineer licensed by the State of New Jersey shall attest to same and be kept on file and be made part of the permit.
B. 
In the event that any permit or certification required by this chapter is denied by the Vernon Township Health Officer, a hearing shall be held thereon before the Mayor and Township Council within 30 days after the request is made by the applicant. Upon such hearing the Mayor and Township Council shall grant or deny the issuance of the permit and place the reason for its decision on the public record.[1]

A. 
Any supplier violating any of the provisions of this chapter, upon conviction thereof, shall be subject to the penalties set forth in Chapter 1, Article II, § 1-19, Violations and penalties, per violation.[1]

B. 
Violations involving more than one dwelling unit shall constitute separate offenses.
C. 
Each day a violation continues shall constitute a separate offense.
A. 
The inability of a supplier to restore service to a system due to circumstances beyond the control of the supplier who is acting in good faith may constitute a defense for violations of § 555-3 of this chapter.
B. 
A supplier may be excused from § 555-3 of this chapter during a drought emergency declared by the Governor of the State of New Jersey for this region or other regulatory authority empowered to declare such emergencies.
Throughout the text of this chapter, the singular shall constitute the plural and the plural shall constitute the singular unless a contrary interpretation is expressly provided therein.
