As used in this chapter, the following terms shall have the meanings indicated:
ROLLER BLADES
Either made of plastic or leather material, shaped in boot or shoe form, with one of more rows of wheels attached to the bottom, propelled by human power and gravity.
SCOOTERS
A vehicle propelled by human power and gravity or by any type of motor device consisting of material or portion of material formed in a thin sheet with wheels attached to the underside and a handle which is attached to the top to use as a steering device.
SKATEBOARD
A vehicle propelled by human power and gravity consisting of material or portion of material formed in a thin firm sheet with wheels attached to the underside.
WAX
Any substance used to enhance the movement of skateboards, roller blades and scooters.
It shall be unlawful for any person to engage in skateboarding, roller blading and scootering or ride upon or propel any skateboard, roller blade and scooters into or upon the following streets, sidewalks, or in the places of business, where signs have been posted, including any and all Borough-owned real property within the Borough of Eddystone:
A. 
Simpson Street between Ninth Street and Chester Pike and the sidewalk along Simpson Street between Ninth Street and Chester Pike.
B. 
Any and all businesses located within the Borough of Eddystone where signs have been posted.
C. 
Chester Pike between the Eddystone-Ridley boundary (Crum Creek) and the Eddystone-Chester boundary (Ridley Creek).
A. 
A person engaged in skateboarding, roller blading and scootering shall obey the instructions of a police officer or other appropriately attired person authorized to direct, control or regulate traffic.
B. 
A person 16 years of age or younger engaged in skateboarding, roller blading and scootering shall at all times wear a safety helmet securely fastened to the head to prevent head injury.
C. 
A person engaged in skateboarding, roller blading and scootering shall obey traffic and pedestrian control signals as provided under the Pennsylvania Motor Vehicle Code, Section 3112 (relating to traffic-control signals) and Section 3113 (relating to pedestrian control signals).
The person engaged in skateboarding, roller blading and scootering shall yield the right-of-way to any pedestrian and may not overtake or pass a pedestrian while riding upon or propelling the skateboard, roller blades and scooter. The operator of such skateboard, roller blades and scooters shall dismount from the skateboard, roller blades and scooter and shall pass or overtake the pedestrian on foot, or wait until the pedestrian passes, prior to remounting the skateboard, roller blades or scooter.
No person engaged in skateboarding, roller blading and scootering shall suddenly leave a curb, sidewalk beam or street or any other place of safety and ride upon or propel any skateboard, roller blades and scooters into or toward the path of a vehicle which is so close as to constitute a hazard. Where there are no pedacycle lanes, persons engaged upon skateboarding, roller blading and scootering upon a roadway shall ride as near to the right of the roadway as practical, exercising due care when passing a standing vehicle or one proceeding in the same direction.
No person shall place a ramp, half-pipe or other structure used for skateboarding, roller blading and scootering in a public thoroughfare or street or upon a sidewalk or municipal parking lot within the Borough of Eddystone.
The operator of any skateboard, roller blades and scooters emerging from any alley, driveway, building or between parked vehicles shall, upon approaching any sidewalk or street, yield the right-of-way to all pedestrians approaching on said sidewalk and vehicles approaching on said street.
No person shall stand, park or otherwise place in a position of temporary or permanent storage any skateboard, roller blades or scooter upon a highway, street, sidewalk or against any building abutting a sidewalk in such a manner that shall obstruct or render injury to a pedestrian or interfere with vehicular traffic.
No person shall operate a skateboard, roller blades and scooters at night unless he/she or she is wearing reflective clothing which shall be visible from a distance of not less than 50 feet and a maximum of 300 feet from the front, side or rear of the skateboard, roller blades and scooters when directly in front of the lawful beams of a headlight on a motor vehicle.
The parent of the minor child or the guardian of any minor child shall not authorize or knowingly permit any such child to violate any of the provisions of this chapter.
Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof:
A. 
Pay a fine not to exceed $25, plus court costs for each offense.
B. 
In the event said person is a minor, the parent, guardian or other person having legal custody of said minor child shall be, upon conviction, sentenced to pay a fine of $25, plus court costs.
