The purpose of this article is to amend, consolidate and/or replace existing legislation regarding alcohol consumption on Borough property, which includes provisions detailed in Tarentum Borough Code Chapter 177, Parks and Recreation, Article II, and Chapter 200, Riverview Memorial Park.
As used in this article, the following terms shall have the meanings indicated:
BOROUGH PROPERTY
Any property titled in the name of Tarentum Borough and all publicly maintained areas and rights-of-way located within the Borough.
Consumption of alcohol on Borough property, including parks, play areas, sport areas, trails and Borough maintained rights-of-way is prohibited unless specifically approved in advance by Tarentum Borough.
The Borough may post notices at each of its properties informing the public of the provisions of this article and of the fines for violation of the same.
It shall be unlawful for any person to violate the provisions of this article. Any person violating the provisions of this article shall be guilty of a summary offense and, upon conviction before a Magisterial District Judge having jurisdiction over same, be sentenced to a fine of not less than $300 and, in default of payment thereof, be sentenced to the maximum punishment provided for summary offenses under Pennsylvania law.
All ordinances or parts of ordinances which are inconsistent herewith are hereby repealed. The provisions of this article are severable. In the event any term or provision of this article are held to be void or invalid, the remaining provisions of this article shall remain in full force and effect.
