A. 
In connection with an application for the issuance of a building permit, the applicant shall, in addition to such other information as is required, certify whether a dumpster for the disposal of materials of any nature or kind will be utilized at the property described in the application for the permit.
B. 
Large bag-type waste containers greater than one cubic yard, such as Bagsters®, will be considered as dumpsters and regulated as such under this chapter.

In the event that the applicant proposes to utilize a dumpster in connection with the work described on the application for the building permit, then the certification supplied by the application shall provide the following information concerning the use of the dumpster:
A. 
The number of dumpsters requested.
B. 
The size of each dumpster.
C. 
The proposed location of each dumpster at the property.
D. 
The anticipated date of removal of each dumpster.
In the event that the applicant proposes to utilize a dumpster with the placement of the same within the public right-of-way of a street or within the cartway of an alley or such that in the Building Inspector's opinion it interferes with the free flow of pedestrian or vehicular traffic at the site, then the Building Inspector shall have the right to conduct an investigation to determine if such placement is reasonably necessary without reasonable alternatives(s).
In the event that the Building Inspector determines that a reasonable alternative exists for such placement, such that the placement will not be in the areas described in § 82-3 above, then the Building Inspector shall communicate such determination to the applicant in writing and request that the applicant revise his/her or its application for the permit to conform to the suggested alternative(s) provided by the Building Inspector.
In the event that the applicant shall agree to such alternate placement, the application for the building permit shall be revised to reflect the same.
In the event that the applicant disagrees with such proposed alternate location, then the Building Inspector may, in his discretion, deny the building permit application.
In the event that the Building Inspector determines that no reasonable alternative exists, then the Building Inspector shall have the discretion to deny the application as submitted or issue the application subject to certain conditions regarding length of time in which the dumpster(s) will be placed at the locations identified in the application. Prior to issuance of the permit, the Building Inspector shall consult with the Police Department to determine what, if any, concerns they may have regarding the placement of the dumpster(s).
The Building Inspector shall have the discretion in issuing a building permit to limit the time of the placement of any dumpster in connection with a building permit application regardless of the proposed location.
The following shall be considered to be violations of this chapter:
A. 
Utilizing a dumpster for disposal of materials of any nature or kind without obtaining a building permit authorizing the same; and/or
B. 
Utilizing a dumpster for disposal of materials of any nature or kind in violation of the approval of the same as given by the Building Inspector or as provided in the building permit.
Any person convicted of violating this chapter shall be fined not less then $50 nor more than $300 per violation. Every day that a violation of this chapter continues shall be considered a separate offense.
