The following words and phrases, as used in this article, shall
have the meanings ascribed herein, unless the context clearly indicates
a different meaning:
Ingram Park, located on Foster Avenue, and the tot lot located
at the Borough Building.
Any building owned by the Borough of Ingram, including, but
not limited to, the Borough Building located on West Prospect Avenue
and Borough-owned buildings on Evans Avenue and Greenwood Avenue.
Includes inhaling, exhaling, burning or carrying any lighted
cigarette, cigar, pipe, or any other smoking equipment (including
any electronic devices).
Smoking is prohibited at all times in or upon the grounds of
Borough parks or Borough public buildings.
"NO SMOKING" signs or the international "NO SMOKING" symbol
(consisting of a pictorial representation of a burning cigarette enclosed
in a red circle with a red bar across it). However, the absence of
a "NO SMOKING" sign shall not justify a violation or preclude enforcement
of this article.
The Borough Council may, but shall not be required to, designate
smoking areas of appropriate size, provided the area has a clearly
marked perimeter, is prominently marked with "SMOKING PERMITTED" signs
and is located the greatest distance practical from buildings, playground
equipment, or pedestrian walkways.
The Borough's Police Department and Code Enforcement Officer
are appointed to enforce this article.

Any person found to be in violation of this article shall be
subject to enforcement by way of citation for a summary offense under
the Pennsylvania Rules of Criminal Procedure. A fine may be imposed
not in excess of $600 for each violation.
