The Police Department of Prospect Park Borough, as heretofore recognized, established and existing, is hereby reestablished as provided in this article. Said Police Department shall consist of such number of police officers as the Borough Council from time to time, by resolution, determines.
A. 
All full-time police officers shall be appointed by the Borough Council, upon recommendations of the Police and Fire Committee, pursuant to the civil service provisions of the Borough Code and the Civil Service Act of the Commonwealth of Pennsylvania, as amended, in effect at the time of such appointment.
B. 
All full-time police officers shall serve a probationary period of one year, following which the appointment shall be permanent.
C. 
Full-time police officers, either prior to their appointment or within such period of time after their appointment, as the Borough Council shall designate, shall undergo and satisfactorily complete a course of training at a police training school authorized by the Borough Council.
A. 
All part-time police officers and special school police officers shall be appointed by and serve at the pleasure of the Borough Council.
B. 
During an emergency in which the safety and welfare of the Borough is endangered, the Mayor may appoint special police officers to service during the period of such emergency.
A. 
The compensation, benefits and conditions of employment of all full-time police officers shall be established and determined from time to time by the Borough Council. Should said full-time police officers form a collective bargaining unit as authorized by law, the compensation, benefits and conditions of employment of the police officers comprising such collective bargaining unit shall be determined and established by negotiations and agreement with the Borough Council.
B. 
The compensation, benefits and conditions of employment of all part-time police officers, special school police and special police appointed in an emergency by the Mayor shall be established and determined from time to time by the Borough Council.
A. 
The regular hours of employment for full-time police officers shall be 40 hours per work week. For the purpose of this section, a "work week" shall be a seven-day period as the Borough Council shall from time to time designate or as otherwise defined in a collective bargaining agreement.
B. 
Hours of employment of full-time police officers in excess of 40 hours per week are authorized only in emergencies or when reasonably necessary to provide scheduled police coverage due to the absence for any reason of a normally scheduled full-time police officer and the unavailability of a part-time police officer to fill the schedule of the absent officer.
C. 
Part-time police officers shall be employed only for such periods of time as shall be required for any emergency or to provide scheduled police coverage for any reason of a normally scheduled full-time police officer.
The police officers of the Borough shall be classified and ranked as follows:
A. 
One (1) full-time police officer shall be designated as Chief of Police by the Borough Council. The Chief of Police shall be the chief executive and administrative officer of the Police Department. The Chief of Police shall be a full-time resident of the Borough of Prospect Park at the time of his appointment or become a full-time resident within six months of his appointment. Any nonresident shall be Acting Chief only until residency is established. Failure to comply with the residency requirement shall be grounds to designate another Chief.
B. 
All other full-time police officers shall be subordinate to the Chief of Police, and one or more of such officers may be designated and ranked from time to time by the Borough Council in the following classifications:
(1) 
Sergeant.
(2) 
Patrolman.
C. 
All part-time police officers shall be classified and ranked as patrolman.
The Chief of Police shall do and perform each of the following:
A. 
Direct the subordinate officers in the performance of their duties. In the absence of the Chief of Police, the next highest ranking officer shall direct and supervise subordinate officers in the performance of their duties. This section specifically authorizes the designation of an officer as investigator as may be needed from time to time.
B. 
Prepare or cause to be prepared and kept all records and reports necessary for the proper and efficient administration of the Police Department.
C. 
Prepare rules and regulations governing the conduct of all police officers in the performance of their duties, their relations with the general public and their relations with other elected or appointed officials of the Borough. Such rules and regulations shall be subject to review by the Mayor and the Police Committee and, upon their adoption by the Borough Council, shall be the duly constituted rules and regulations of the Police Department.
D. 
Prepare and post duty schedules for all full-time police officers, including the Chief of Police. Such duty schedules shall be so designated and implemented to the effect the following:
(1) 
A productive and efficient deployment of all full-time police officers.
(2) 
Provide regular police coverage of the Borough each week for a number of hours equal to the product of 40 multiplied by the number of full-time police officers employed by the Borough.
(3) 
Minimize the need to employ full-time police officers on overtime status or to employ substitute part-time officers as provided in § 27-5 of this article.
E. 
Promptly report to the Borough Secretary requests for vacation days, sick days or leaves of absence.
It shall be the duty of the members of the Police Department to see to the enforcement of all ordinances of the Borough and all statutes effective in the Borough and to preserve order and prevent infractions of the law and to arrest violators. Every member of the Police Department is hereby declared to be a conservator of the peace.
The Police and Fire Committee is hereby authorized to adopt, subject to the approval of the Borough Council, such rules and regulations with respect to the Police Department of the Borough as it may deem proper.
All new members shall be appointed as probationary patrolman, and no person shall be promoted from patrolman of any class to a higher class except in accordance with the requirements of the rules and regulations of the Civil Service Commission, the Police and Fire Committee and the Borough Council. Neither shall any member of the Police Department be demoted except in accordance with the provisions of the Civil Service Act[1] of the Commonwealth of Pennsylvania.

The Chief of Police and all members of the Police Department shall be under the supervision of the Mayor, who shall have, in addition to other powers, the power, for cause and without pay, to suspend any member of the Police Department until the succeeding regular meeting of the Council, at which time or thereafter the Council may, subject to applicable law, suspend, discharge, reduce in rank or reinstate with pay such policeman.
Nothing set forth in §§ 27-1 through 27-11 of this article shall be deemed to diminish the duty of the Mayor of the Borough to direct the manner and time in which the police officers of the Borough shall perform their duties.

The Borough hereby directs the Civil Service Commission to require that:
A. 
All officers and employees of the Police Department of Prospect Park must be citizens of the United States. It is not necessary that applicants for employment reside within the boundaries of Prospect Park. However, all applicants must agree, in writing, to establish permanent residence within a five-mile radius of the Prospect Park Police Station within six months after completing their probationary period and gaining permanent status and must continue to reside within a five-mile radius of the police station during their tenure unless otherwise specifically authorized by the Borough.
B. 
All officers and employees of the Department must maintain their principal residence within a five-mile radius of the Borough Police Station. All permanent full-time officers and employees currently employed by the Borough shall be entitled to maintain their current residence, but upon any relocation, their principal residence shall be within a twenty-five-mile radius of the police station.
