The following definitions shall apply in the interpretation and enforcement of this chapter:
AUTOMATIC DIALING PROTECTIVE DEVICE
An electrically operated instrument composed of sensory apparatus and related hardware which automatically transmits a prerecorded voice alarm over regular telephone lines by direct or indirect connection to the Prospect Park Borough Police Department or Fire Department upon receipt of a stimulus from a sensory apparatus that has detected a physical force or condition inherently characteristic of a fire or intrusion which activates a response by the Prospect Park Borough Police Department or Fire Department.
AUTOMATIC PROTECTION DEVICE
An electrically operated instrument composed of sensory apparatus and related hardware which automatically transmits an electrical signal to the Prospect Park Borough Police Department or Fire Department indicating that a physical force or condition exists which is inherently characteristic of a fire or intrusion and causes the Prospect Park Borough Police Department or Fire Department to respond to the signal.
FALSE ALARM
Any signal activated by an automatic protection device or automatic dialing protective device or any alarm audible beyond the confines of the structure that it is protecting or any other kind of direct or indirect signal given to the Prospect Park Borough Police Department or Fire Department to which police or firemen respond which is not the result of a burglary, fire, robbery, attempted burglary, attempted robbery or similar emergency. Alarm activation caused by electrical failures beyond the control of the owners of the structure protected, electrical storms or acts of God shall not be considered "false alarms."
Any person, firm or corporation having a fire alarm, smoke detector or other type of alarm, which alarm has a direct or indirect connection which calls for the response from the Police Department or Fire Department or has an audible alarm which calls for the response from the Police Department or Fire Department from any building, apartment or business establishment, shall be assessed a fee in accordance with the schedule set forth hereinafter for any false alarm as defined in this chapter.
A. 
Whoever violates this chapter shall pay a fee to the Borough of Prospect Park according to the following schedule:
(1) 
First, second and third offenses in any calendar year: a warning.
(2) 
Fourth, fifth and sixth offenses in any calendar year: $25 each.
(3) 
Seventh and subsequent offense in any calendar year: $75 each.
B. 
Any fee assessed hereunder shall be due and payable to the Borough at the Borough Office within five days after the notice of violation. The date of the notice shall be the date of mailing.
No person, firm, business or corporation shall conduct any tests or demonstrations of an automatic protection device or automatic dialing protective device without first obtaining permission from the Police Department or Fire Department, as appropriate.
The failure of any person, firm, business or corporation to comply with the requirements of this chapter shall constitute an offense punishable by a fine of not less than $25 nor more than $300, plus costs.
