This chapter shall be known and may be cited as the "Prospect Park Borough Development and Zoning Ordinance."
A. 
To promote, protect and facilitate the public health, safety and welfare; coordinated and practical community development; proper density of population; and the provision of adequate light and air, police protection, vehicle parking and loading space, transportation, water, sewerage, schools, public grounds and other public requirements.
B. 
To prevent the overcrowding of land; blight; danger and congestion in travel and transportation; and loss of health, life or property from fire, flood, panic or other dangers.
A statement of goals and objectives concerning the future of the Borough relative to the issues of land use, municipal services and transportation is contained in the Prospect Park Borough Comprehensive Plan.
A. 
Application. The provisions of this chapter shall apply to all buildings, structures, uses, land and all accessory buildings, structures and uses. Nothing in this chapter shall require any change in plans or construction of a use for which a building permit has been heretofore issued prior to the effective date of this chapter.
B. 
Interpretation. The provisions of this chapter shall be held to be the minimum requirements for the promotion of the health, safety and general welfare of the Borough. It is not intended to interfere with, abrogate, annul or cancel other rules, regulations, ordinances, covenants or restrictions except where this chapter imposes greater restrictions, in which case, the provisions of this chapter shall apply.
C. 
Severability. Should any section or provision of this chapter be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this chapter as a whole or of any other part thereof.
D. 
Amendment. The Borough Council may, from time to time, amend, supplement, change, modify or repeal this chapter, including the Zoning Map,[1] in accordance with the provisions of the Pennsylvania Municipalities Planning Code.[2]

E. 
All ordinances or parts of ordinances inconsistent herewith are hereby revoked, and all prior existing zoning regulations are hereby repealed.
F. 
Enactment. This chapter shall become effective on May 11, 1994, and shall remain in force until modified, amended or rescinded by the Council of the Borough of Prospect Park, Delaware County, Pennsylvania.
