A. 
There shall be a Department of Public Works the head of which shall be the Director of Public Works. The Director of the Department of Public Works, hereinafter referred to as the "Director," shall be appointed by majority vote of the governing body and shall hold office until December 31 of each year of said appointment. Any vacancy in said office shall be filled by the governing body for the unexpired portion of such term. The Director shall be qualified by training, experience and in accordance with the law.
B. 
This article concerning Department of Public Works shall supercede Chapter 48, Art. VII, of the Code of the Borough of Eatontown entitled "Superintendent of Public Works" and Chapter 48, Art. VII, as aforesaid stated shall be deleted and repealed.
A. 
The Director shall be under the direction of the Borough Administrator. The Director will plan, organize, and direct the programs and activities of a comprehensive public works department.
B. 
The Director shall evaluate the need for and recommend the appropriate number and specialized functions of those divisions to be established within the Department of Public Works.
C. 
The Director shall be responsible for, but not be limited to, the following duties:
(1) 
Develop, administer and implement public works programs.
(2) 
Establish priorities among work programs.
(3) 
Manage overall operations of the Department with responsibility for developing Department goals and objectives.
(4) 
Recommend the hiring, firing, promotion, demotion, and/or disciplining of employees.
(5) 
Prepare the annual operating and capital improvement budgets.
(6) 
Recommend for approval the expenditures of all funds by voucher chargeable against the Department's budget.
(7) 
Establish, keep and maintain all necessary books, records, field notes, maps, surveys and similar materials necessary to perform the duties of the office of Director and turn over all such records to his/her successor or to the Borough Administrator upon termination of employment with the Borough.
(8) 
Supervise the performance of the work of personnel assigned to the Department.
(9) 
Receive and investigate all complaints from residents relating to the Department's operations.
(10) 
Study and review the operations of the Department and its divisions, seeking ways to maximize their effectiveness and efficiency.
(11) 
Direct and oversee the Division Managers. Evaluate the performance of their respective divisions and make recommendations to improve their operations.
(12) 
Assign an Acting Director in his/her absence.
(13) 
Perform other duties as assigned.
A. 
Prerequisite. The Director shall be qualified as a Municipal Superintendent of Public Works pursuant to N.J.S.A. 40A:9-154.5 through 40A:9-154.6h, as amended and supplemented.
B. 
Educational requirements and experience. The Director shall hold a Bachelor of Science Degree in civil engineering with a minimum of two years' experience and training to perform the duties of this office; or shall be the holder of a valid professional engineer's license issued by the State of New Jersey; or shall have a minimum of five years' supervisory experience in the operation of all aspects of a Department of Public Works similar to that established by the Borough of Eatontown.
Within the Department of Public Works there shall be the following Divisions, each of which will be headed by a Division Manager:
A. 
Division of Automotive Services.
B. 
Division of Streets and Sanitation.
C. 
Division of Parks and Shade Trees.
D. 
Division of Buildings and Grounds.
The Division of Automotive Services is for the purpose of maintaining and repairing the vehicles of the Department of Public Works and those of other Departments of the Borough as authorized by the Director, subject to budgetary allowances. The Division shall also maintain all other motorized equipment owned by the Borough of Eatontown.
The Division of Streets and Sanitation shall maintain and repair the streets, roads, culverts and drainage of the municipality and correct and reconstruct such streets as may be authorized and make use of outside contractors and professionals where necessary upon authorization by the Borough Council pursuant to the procedures and requirements of law. The Division shall also clear and remove snow and ice from the streets and provide such services as may be required in the interest of public safety as authorized. The Division shall also collect and dispose of all refuse, trash, etc., authorized to be collected from the Borough unless the Borough after consultation with the Division has chosen to contract out for services pursuant to law and to the extent the Borough has chosen to do so.
The Division of Parks and Shade Trees shall maintain and repair municipal parks and grounds and outdoor recreational areas; and provide for the planning, protection and maintenance of shade trees and shrubbery on public streets, parks and highways of the Borough to the extent allowed by the Code of the Borough of Eatontown and the laws of the State of New Jersey.
The Division of Buildings and Grounds shall provide for the cleaning and maintenance of buildings and grounds and the operation of elevators and related duties for the Borough of Eatontown with regard to the Borough property and to the extent that the Mayor and Council have chosen not to contract out pursuant to law for such services.

Within the Department of Public Works, there shall be a General Foreman who shall serve under the direction of the Director of Public Works. The General Foreman will assist the Director of Public Works in planning, organizing and directing the workforce, including Division Managers. The General Foreman may be assigned to head one or more of the Divisions with the Department while assisting in overseeing all others. The General Foreman will fulfill the duties of the Director of Public Works in his/her absence and perform other duties as assigned by the Director.
