No person shall at any time within the territorial limits of the Borough of Eatontown hunt for, take or kill, by any means whatsoever, a wild bird, animal or fowl. Nothing herein contained shall prohibit the trapping of any bird, animal or fowl by use of a cage-type trap commonly called "cage trap," "cage door trap" or "live trap" or any other device designed to capture animals alive and unharmed.

Nothing contained in the aforementioned section shall be construed to prevent a person, on property owned or occupied by him within the Borough of Eatontown, from using a gun, firearm or other weapons in defense of his person or property for the purpose of destroying rodents, birds or other animals where such rodents, birds or other animals are a nuisance being an agency of destruction to property or injurious to the health and welfare of the owner or occupier; provided, however, the destruction of such rodents, birds or other animals shall be permitted by state statute or a state agency presently designated as the Fish and Game Commission.

Any person violating the provisions of this chapter shall be subject, upon conviction thereof, to a fine of not less than $500 for each offense or imprisonment in the county jail for not more than 30 days, or both, at the discretion of the court.
