A certain document, three copies of which are on file in the office of the Borough Manager of the Borough of Colwyn being marked and designated as the International Property Maintenance Code, 2006 Edition, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Borough of Colwyn in the State of Pennsylvania for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Borough of Colwyn are hereby referred to, adopted, and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 115-6 of this article.
The following sections are hereby revised:
A. 
Section 101.1. "Borough of Colwyn" shall be inserted in the second line where the words "(name of jurisdiction)" appear.
B. 
Section 103.5. The Borough's Code Department Fee Schedule will be as follows:
(1) 
Fee for every building permit of $1,000 (plus a state fee of $4) (any building permit, roofing permit, flat roof permit, etc.): $25.
(2) 
Contractor's registration fee: $50.
(3) 
U & O inspection/unit: $75.
(4) 
Reinspection fee: $35.
(5) 
Rental license fee/unit: $75.
(6) 
Plumbing permit: $50.
(7) 
Business license fee: $75.
(8) 
Vendor license: $250.
(9) 
Hearings and appeals before the Zoning Hearing Board (residential and commercial): $500.
C. 
Section 302.4, Weeds. Insert the words "seven inches" in the second line where the words "(jurisdiction to insert height in inches)" appear.
D. 
Section 304.14, Insect screens. Insert the words "May 15 to October 15" in the first line where the words "(date) to (date)" appear.
E. 
Section 602.3, Heat supply. The words "October 15 to May 15" shall be inserted in the third line where the words "(date) to (date)" appear.
F. 
Section 602.4, Occupiable work spaces. The words "October 15 to May 15" shall be inserted in the first line where the words "(date) to (date)" appear.
Ordinance No. 487 of Borough of Colwyn, entitled Property Maintenance Code ("BOCA National Property Maintenance Code, Third Edition, 1993," as published by the Building Officials and Code Administrators International, Inc.), and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.
If any section, subsection, sentence, clause or phrase of this article is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this article. The Borough of Colwyn hereby declares that it would have passed this article, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
Nothing in this article or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 115-7 of this article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
The Borough Manager is hereby ordered and directed to cause this article to be published.
This article and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect from and after the date of its final passage and adoption.
