This article is for the purpose of compliance with Paragraph Number V.B.1 of the Solid Waste Disposal Agreement between the City of Arcadia and the County of La Crosse dated March 14, 1991 (herein called "Agreement").
As used in this article, the following terms shall have the meanings indicated:
RDF FACILITY
The resource recovery facility, plus any improvements or additions thereto, used for the weighing and processing of acceptable waste, as defined in the Agreement, into refuse-derived fuel as an energy source which is operated and maintained by the Northern States Power Company (herein called "NSP") and which is located in La Crosse County, Wisconsin.
All acceptable waste, as defined in the Agreement, generated within the territorial limits of the City of Arcadia shall be delivered to the La Crosse County RDF Facility pursuant to the terms and conditions of the Agreement.
This article shall not be applicable to wood waste generated by Ashley Furniture Industries, Inc., or acceptable waste generated by St. Joseph Hospital; provided, however, that nothing herein shall be construed to prohibit either Ashley Furniture Industries, Inc., or St. Joseph's Hospital from delivering acceptable waste, as defined in the Agreement, to the RDF Facility pursuant to the terms and conditions of the Agreement and the applicable ordinances of the City of Arcadia.
Any person, firm, organization, corporation or other affiliation who or which violates this article shall be subject to a fine of not less than $25 nor more than $200 for each violation thereof.
