This chapter is enacted pursuant to § 62.11(5), Wis. Stats.
As used in this chapter, the following terms shall have the meanings indicated:
BICYCLE
Any device propelled by the feet acting upon pedals and having wheels any two of which are not less than 14 inches in diameter.
CITY
The City of Arcadia, Wisconsin.
LICENSE
A license for a bicycle that is issued pursuant to this chapter.
POLICE DEPARTMENT
The Police Department of the City of Arcadia, Wisconsin.
STREET or STREETS
Any public street or highway within the City of Arcadia.
It shall be unlawful for any person residing in the City to ride or use a bicycle that is not licensed as required by this chapter.
A. 
The Police Department is hereby authorized and directed to issue, upon written application on a form provided by the City Clerk-Treasurer, a license to residents of the City that shall be effective for the duration of time that the bicycle is owned by the applicant. The license shall entitle the bicycle to be operated upon all streets, and upon the sidewalks in the City where operating a bicycle is not prohibited.
B. 
The Police Department shall provide the license, which shall have numerical number stamped thereon, and letters indicating that the license was issued by the City. The license shall be suitable for attachment to a bicycle at a location where it will always be plainly visible and shall remain attached to the bicycle. The issuance of a license shall be after the collection of the registration fee for the license as provided for in § 155-8.
C. 
Fees collected by the Police Department for the licenses provided for in this chapter shall be submitted by the Police Department to the City Clerk-Treasurer as collected and under conditions to be determined by the City Clerk-Treasurer. The Police Department shall keep a record of the date of issue of each license.
It shall be the duty of the purchaser of a bicycle which is licensed under this chapter to apply to the Police Department for the transfer of the license with two business days of the date of purchase of said licensed bicycle.
Is shall be unlawful for any person, firm, partnership or corporation to:
A. 
Willfully or maliciously remove, destroy, mutilate or alter the number of any license issued pursuant to this chapter; or
B. 
Remove, destroy, mutilate or alter any license during the time in which said license is valid.
A. 
Each person operating a bicycle shall comply with all motor vehicle traffic laws of the City and State of Wisconsin, including traffic signs, except where such laws do not apply to bicycles.
B. 
A person propelling a bicycle shall not ride other than upon or astride a permanent regular seat attached thereto.
C. 
No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped.
D. 
No person operating a bicycle shall carry any package, bundle, or article which prevents the operator from keeping at least one hand upon the handlebars at all times.
E. 
No person operating a bicycle shall attach himself or his bicycle to any vehicle.
F. 
Unless preparing to make a left turn, every person operating a bicycle upon a street carrying two-way traffic shall ride within three feet of the right side of the unobstructed street. On a one-way street, the operator of the bicycle shall ride within three feet of the right side or left side of the unobstructed street. Every person operating a bicycle upon a street shall exercise due care when passing a standing vehicle or one proceeding in the same direction, with a minimum of three feet between the bicycle and the vehicle.
G. 
All persons riding a bicycle on a street shall ride in a single file.
H. 
Wherever a path for a bicycle has been provided adjacent to a street, the operator of a bicycle shall use such path and not use the street.
I. 
No person may operate a bicycle upon a street where a sign is erected indicating that such operation is prohibited.
J. 
Every person operating a bicycle upon a sidewalk shall yield the right-of-way to pedestrians and exercise due care in giving an audible signal when passing a pedestrian proceeding in the same direction.
K. 
Before turning or changing the direction of any bicycle upon any street or other public place, it shall be the duty of the operator thereof to give a signal by the extension of the hand to indicate the direction of the turn.
L. 
No person may operate a bicycle upon the streets or public places of the City during the hours of darkness unless such bicycle is equipped with or the operator is wearing a lamp emitting a white light visible from a distance of at least 500 feet to the front of such bicycle. Such bicycle shall also be equipped with a red reflector that has at least two square inches of surface area on the rear so mounted and maintained as to be visible from all distances from 50 feet to 500 feet to the rear when directly in front of lawful upper beams of headlamps on a motor vehicle. A lamp emitting a red light visible from a distance of 500 feet to the rear may be used in addition to but not in lieu of the red reflector.
M. 
It shall be unlawful to operate a bicycle upon streets and public places of the City that is not equipped with adequate brakes, tires and reflectors, all of which are in proper working order.
The following fees shall be collected by and paid to the Police Department:
A. 
The fee to be paid for each license shall be established by the Common Council by resolution.
B. 
In the case where the transfer of bicycle ownership is made in the manner prescribed in this chapter, the fee for the transfer of said license shall be established by the Common Council by resolution.
C. 
Upon the loss of a license, and upon evidence of said loss satisfactory to an officer of the Police Department, a new license shall be issued upon payment of a fee established by the Common Council to the Police Department.
A. 
Any person, 15 years of age and under, who violates any of the provisions of this chapter relating to the motor vehicle traffic laws or the bicycle safe riding rules and regulations and the official police instructions for the safe operation of a bicycle shall be, for the first offense, reprimanded in writing by the Police Department, addressed to the parents or guardian of the offender, stating the nature of the violation and a warning that a repetition of the violation, or any other violation, must be prevented by the parents or guardian.
B. 
Except as otherwise provided herein, any person violating any of the provisions of this chapter shall, upon conviction thereof, pay a forfeiture of $50 plus applicable court costs and fees.
Any bicycle that has remained unmoved from any public location within the City for a period of 24 hours may be considered abandoned and impounded by the Police Department. Upon the impoundment of any bicycle, the Police Department shall attempt to contact the license holder or owner of the bicycle, if known, and inform him of the impoundment.
Whenever any bicycle shall be impounded for violation of the provisions of this chapter it shall be surrendered to the license holder upon the payment of a charge for storage, at the discretion of the Chief of the Police Department, but if a charge is made it shall not exceed $10. In the case a bicycle is impounded and it is not claimed by the license holder within 60 days from the date of impoundment, then it shall be determined by the Chief of the Police Department or his or her designee as to whether the bicycle is to be destroyed, sold or given away. The proceeds of the sale shall be remitted to the City Clerk-Treasurer.
