All sidewalks ordered repaired, constructed or reconstructed within the City limits, regardless of estimated or actual cost, shall be repaired, constructed or reconstructed directly by the City, without submitting the same for bids.

It shall be unlawful to erect a tent on a street or alley within the City of Arcadia unless a tent placement permit has first been obtained.
A. 
A tent placement permit shall not be issued unless an application for such permit, attached hereto as Exhibit A,[1] the provisions and requirements of which are incorporated herein by reference, is submitted to the City Clerk-Treasurer. The application must be submitted with sufficient time for the City of Arcadia to act on it and, if approved, with sufficient time for the applicant to provide the notice required under § 336-5 of this article. The application shall include a diagram of the tent and street or alley, drawn on a scale of not less than one inch equals 100 feet. The diagram shall show the location of the tent on the street and the portion of the street that will remain unobstructed for traffic, as provided under § 336-7 of this article.

The permit application is subject to approval by the Common Council. The Common Council shall set the number of days the permit shall be valid.
C. 
The applicant shall pay a nonrefundable application fee established by the Common Council by resolution to the City of Arcadia upon submitting the application. Prior to the permit being issued, the permit applicant shall pay a fee for issuance of a tent placement permit established by the Common Council by resolution to the City of Arcadia for each day for which the permit is to be in effect. The City Clerk-Treasurer shall not issue the permit until such fees as are required by this article are paid.[2]

D. 
In no event shall a tent be permitted to be erected for longer than two months.
Not more than 10 days after approval of the permit application and at least five days before the tent will be erected, the applicant shall notify all owners of property abutting the street on which the tent will be erected and within 300 feet of either side of the property on which the tent will be erected. Such property owners shall be notified of the date or dates during which and the location at which the tent will be erected. Such notice may be oral or in writing. If in writing, such notice shall be delivered either personally to the owner of the property or by certified mail to the mailing address of the owner of the property.

In addition to other fees imposed by this article, anyone who erects a tent on a street within the City of Arcadia shall pay a fee established by the Common Council by resolution. The fee shall be paid prior to the issuance of the permit.[1]

Additionally, the permit applicant shall fill the tent stake holes with a tar or asphalt filler, as determined by the City of Arcadia in its sole discretion, when the stakes are removed.
C. 
The holder of a permit shall notify Diggers Hotline at 1-800-242-8511 a minimum of three days prior to driving any stakes into the pavement so that local utility structures and components are located. No stakes shall be installed until all underlying utility structures and components are located. The permit holder shall ensure that stakes or other items are not driven into the ground in a manner that will damage or otherwise affect utilities.
A. 
Notwithstanding the fact that a person may have obtained a tent placement permit, it shall be unlawful for anyone who has erected a tent on a street or alley within the City of Arcadia to fail to erect and maintain barricades reasonably sufficient to inhibit people from walking into traffic. Reasonably sufficient barricades include ropes.
B. 
Anyone who has erected a tent on a street or alley within the City of Arcadia shall keep a lane on the street or alley and adjacent to the tent open at all times to allow emergency response vehicles to service the vicinity and to permit the movement of traffic on the lane. This lane shall be a minimum of 20 feet wide.
A. 
Any permit holder who wants to extend the dates of the permit must submit an application for a tent placement permit to the City Clerk-Treasurer. The City Clerk-Treasurer shall, as soon as practicable, present such application to the Mayor, who may call a special meeting of the Common Council at the applicant's expense. At such meeting the Common Council shall approve or deny the permit extension.
B. 
The extension applicant shall pay a nonrefundable application fee established by the Common Council by resolution plus the cost of a special Council meeting to the City of Arcadia upon submitting the application. The cost for a special Council meeting shall be established by the Common Council by resolution. Prior to the extension permit being issued, the extension applicant shall pay to the City of Arcadia a fee for issuance of an extension permit established by the Common Council by resolution for each day for which the extension permit is to be in effect. The City Clerk-Treasurer shall not issue the permit until such fee is paid.[1]

C. 
If the Mayor determines a special meeting of the Common Council is not necessary, the cost of the special Council meeting paid by the applicant shall be refunded to the applicant.
If the permit holder, after receiving oral or written notice from the City of Arcadia, fails to immediately remove the tent, then the City may do so and charge the cost of such removal to the permit holder.
Any person who violates any of the terms or conditions of the permit application, permit or any provision of this article shall, upon conviction for each such violation, be subject to a forfeiture of not less than $50 nor more than $500, plus costs of prosecution. Each day during which a violation exists shall be deemed and constitute a separate violation.
