It shall be the duty of any owner, occupant or tenant of real
property in the Village of Canajoharie to keep the sidewalks abutting
or adjoining the real property owned or occupied by such owner, occupant
or tenant, free and clear of snow or ice at all times and any owner,
occupant or tenant of real property who fails to keep such sidewalk
free and clear of snow or ice shall be liable for any loss, injury
or damage to any third party caused by such failure on the part of
such owner, occupant or tenant and shall be subject to the fine or
penalty provided by this chapter, which may be assessed against the
property by the Village Board.
It shall be unlawful for the owner, tenant or occupant of any
building within the corporate limits of the Village of Canajoharie
to permit snow or ice to accumulate on such building adjacent to any
Village street or sidewalk or to permit snow, ice or water to fall
from such building upon any such street or sidewalk so as to constitute
a hazard to persons lawfully using or occupying any such street or
sidewalk.
It shall be unlawful hereafter for any person or firm to throw
or deposit any snow or ice or to permit or cause any snow or ice to
be thrown or deposited nearer the center of any public street or right-of-way
in the Village of Canajoharie, New York, than the outer edge of the
ridge caused or created by the snow plowing operations of the Department
of Public Works of said Village of Canajoharie.
