Any Acting Village Justice hereafter appointed by the Village Board of the Village of Canajoharie shall be a resident of the Village of Canajoharie.

The Village of Canajoharie Board of Trustees finds that the appointment of a trained and otherwise duly qualified Code Enforcement Officer has been difficult to make and retain from the limited number of available local or even greater number of countywide residents. The Board of Trustees finds further that Section 10 of the Municipal Home Rule Law allows a Village, by local law, to supersede statutory residency requirements for appointed public officers.
The appointment of a Code Enforcement Officer for the Village of Canajoharie may hereafter be made by the selection of a resident from either the County of Montgomery or any county physically adjoining the County of Montgomery.
The term of office of Code Enforcement Officer shall be one year effective from the date of the Village organizational meeting.
