It shall be the duty of any owner, occupant of real property
in the Village of Canajoharie to maintain and/or repair the sidewalk
and the curb areas abutting or adjoining the premises of such owner
or occupant in a safe and usable condition at all times and any owner
or occupant, who shall fail to maintain and/or repair such sidewalk
or curb areas in a safe and usable condition shall be liable for any
loss, damage or injury to any third party resulting from the failure
of such owner or occupant to maintain and/or repair such sidewalk
or curb areas. Any owner or occupant of such real property who shall
fail, within 24 hours from receipt of written notice from the Department
of Public Works of the Village or the Village Code Enforcement Officer,
to maintain and/or repair such sidewalk or curb areas shall be subject
to fine or penalty as provided by this chapter and shall be liable
for the cost of such maintenance and/or repair, performed by the Village,
which cost may be assessed against the property by the Village Board.
