The title of this chapter is the "Village of Hollandale All-terrain Vehicle and Utility Terrain Route Ordinance." The purpose of this chapter is to establish all-terrain vehicle and utility terrain vehicle routes in the Village of Hollandale and regulate the operation of all-terrain vehicles and utility vehicles in the Village.
The Board of the Village of Hollandale, Iowa County, Wisconsin, by this chapter, adopted on proper notice with a quorum and roll call vote by a majority of the Village Board present and voting, provides the authority for the Village to designate all-terrain vehicle and utility terrain vehicle routes in the Village, and to regulate the use of those routes and all-terrain vehicles and utility terrain vehicles in the Village.
A. 
Operation shall be subject to all provisions of § 23.33, Wis. Stats., which is adopted as a part of this chapter by reference, pursuant to § 23.33(11), Wis. Stats.
B. 
Pursuant to § 23.33(4)(d)4., Wis. Stats., except as otherwise provided in § 23.33(4), Wis. Stats., no person may operate an all-terrain vehicle or utility terrain vehicle on the roadway portion of any street in the Village except on roadways that are designated as all-terrain vehicle and utility terrain vehicle routes by this chapter. On paved roadways, all-terrain vehicles and utility terrain vehicles must be operated on the paved portion of the roadway and not on the gravel shoulder or ditch.
The following roads are designated as routes:
A. 
Under § 23.33(4)(d)3b, Wis. Stats.; § 23.33(11)(am)3, Wis. Stats.; and § 23.33(11)(am)4, Wis. Stats., STH 191 (also known as "Commerce Street") in the Village of Hollandale and Town of Moscow, from west of the designated ATV parking lot at the junction of Main Street and Commerce Street (WIS 191), along STH 191 (Commerce Street) towards the park to the 5th Avenue intersection, then from the intersection with 5th Avenue North on WIS 191 over the bridge to the County Road K intersection, including the bridge over the Pecatonica River, in the Town of Moscow, Section 30, Town 5 North, range 5 east; a total distance of 0.10 mile more or less.
Pursuant to § 23.33(8)(d), Wis. Stats., the following restrictions are placed on the use of the Village all-terrain vehicle routes designated by this chapter:
A. 
Routes shall be marked with uniform all-terrain vehicle route signs in accordance with § NR 64.12(7), Wis. Adm. Code. Installation and maintenance of all ATV signs on state highways shall meet Wisconsin DOT requirements. No person may do any of the following in regard to signs marking Town all-terrain vehicle routes:
(1) 
Intentionally remove, damage, deface, move or obstruct any uniform all-terrain vehicle route or trail sign or standard or intentionally interfere with the effective operation of any uniform all-terrain vehicle route or trail sign or standard if the sign or standard is legally placed by the state, any municipality or any authorized individual.
(2) 
Possess any uniform all-terrain vehicle route or trail sign or standard of type established by the Department for the warning, instruction or information for the public, unless he or she obtained the uniform all-terrain vehicle route or trail sign or standard in the lawful manner. Possession of a uniform all-terrain vehicle route or trail sign or standard creates a rebuttable presumption of illegal possession.
B. 
Operation shall be subject to all provisions of § 23.33, Wis. Stats., which is adopted as a part of this chapter by reference, pursuant of § 23.33(11), Wis. Stats.
C. 
A copy of this chapter shall be sent by the Village Clerk to the Iowa County Sheriff Department and DNR of Wisconsin Department of Natural Resources, PO Box 7921, Madison, WI 53707.
D. 
In addition to the provision of § 23.33, Wis. Stats., the following restrictions are placed on the use of the Village all-terrain vehicle routes designated by this chapter:
(1) 
All ATV/UTV operators shall observe a speed limit of 30 miles per hour or the posted roadway speed limit, whichever is lower. The speed limit on any of the Village streets is 10 miles per hour, but can go to 25 miles per hour when you turn north by the park. Signs will be posted.
(2) 
All ATV/UTV operators shall ride single file.
(3) 
All ATV operators age 12 or born on or after January 1, 1988, shall possess a valid state-issued ATV safety certification.
(4) 
UTV operators must be 16 years old and possess a valid state-issued safety certificate, if born after January 1, 1988.
(5) 
All ATV operators ages 12 and under 15 must be under the direct supervision of a parent or legal guardian at all times when operating on designated all-terrain vehicle routes.
(6) 
ATVs may operate within the Village of Hollandale as designated in § 356-4 from April 1 to November 1 between the hours of 6:00 a.m. and 11:00 p.m.

This chapter may be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin.
The penalties under § 23.33(13)(a), Wis. Stats, are adopted by reference.
If any provision of this chapter or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or application of this chapter that can be given effect without the invalid provision or application, and to this end, the provisions of this chapter are severable.
The Village Clerk shall properly publish this chapter as required under § 60.80, Wis. Stats. This chapter will become effective upon passage and publication.
