A. 
It is hereby declared to be the purpose of this article to regulate the closing hours of various retail businesses within the Borough of Paramus in order to avoid the noise, inconvenience and disturbance to residential areas within the Borough which are caused when retail establishments remain open during the late evening hours. It is hereby declared and determined to be in the best interest of the health, safety and welfare of the residents of the Borough of Paramus that the retail businesses regulated by this article cease the conduct of their business at a reasonable hour.
B. 
It is a further purpose of this article to distinguish between retail service stations which are located in the commercial zones of the Borough, the closing hours of which are not regulated herein, and retail service stations located within the residential zoning districts in the Borough, the closing hours of which are regulated for the reasons hereinabove set forth.
As used in this article, the following terms shall have the meanings indicated:
RETAIL BUSINESS
Includes any business which holds itself out to the general public for the sale at retail of goods and services.

A. 
Every retail business within the Borough of Paramus shall be closed to the public and business with the public therein shall be and is hereby prohibited after the hour of 11:00 p.m. and before the hour of 7:00 a.m. of any day. The provisions of this section shall not apply to gasoline service stations or to restaurants whose primary purpose is the sale at retail of prepared meals or food and/or beverages for consumption upon the premises of such restaurants, provided that this section shall not apply or in any way limit the provisions of Chapter 157, Alcoholic Beverages.
B. 
All exterior and window electrical lighting or illumination, whether temporary or permanent, for each retail business shall be extinguished at the closing time of said business. The provisions of this subsection shall not apply to security lights nor to open gasoline service stations or to open restaurants whose primary purpose is the sale at retail of prepared meals or food and/or beverages consumption upon the premises of such restaurant.

C. 
A contractor is prohibited from performing work of any kind between the hours of 7:00 p.m. and 7:00 a.m. in residential zones, regardless of any lesser limitation otherwise set forth in the Paramus Code. "Contractor" means any person or company that provides goods or services to another person or company under terms specified in a contract or within a verbal agreement. A homeowner may perform home improvement or yard work at their own property between the hours of 7:00 a.m. and the later of 7:00 p.m. or dusk without violating this section. "Homeowner" means a person living in or owning a home.

Any gasoline service station which is located in any of the zoning districts of the Borough other than a business district, the BG General Business District or the BIL Business-Limited Industrial District, as defined and established in Chapter 429, Zoning, as amended, shall be closed to the public, and business therein shall be and is hereby prohibited before the hour of 6:00 a.m. and after the hour of 12:00 midnight on any day.
