Pursuant to applicable provisions of the statutes of the United States of America and the Commonwealth of Pennsylvania, the Borough of Churchill, Allegheny County, Pennsylvania, hereby establishes the Borough of Churchill Welfare Benefit Plan[1] to be funded through current donations and other contributions.

This Welfare Benefit Plan shall be under the direction and supervision of the Council of the Borough of Churchill and shall be operated under such regulations of the Council of the Borough of Churchill as the Council of the Borough of Churchill may, by ordinance or resolution, prescribe for the benefit of those who retire as regular, full-time, salaried members under the normal retirement provisions of the Police Department of the Borough of Churchill and all other employees of the borough retiring under the normal retirement provisions of the borough.
The Borough of Churchill hereby directs and accepts the transfer of inadvertent contributions from the Police Pension Plan of the Borough of Churchill as authorized by Ordinance No. 614, as amended, under paragraphs 7C, 8(B)(1) and 8(E) which provided for payments from the Borough of Churchill police to provide for various benefits and which contributions now are directed to the proper vehicle.
The moneys received by the plan through the transfer of contributions shall be managed by the Borough of Churchill for retired former members of its Police Department and other retired employees and shall exist so long as there are funds to provide benefits as hereinafter set forth.
The Borough of Churchill shall pay to those officers and employees normally retiring from service with the borough after the effective date of this plan the sum of $150 monthly as an additional benefit over and above any other benefits received under any other pension plan or borough contract. It is the intent of this plan to fund an amount sufficient to allow retirees of the Churchill Borough Police Pension Plan to pay for part of their medical insurance premium costs from the date of their retirement until their eligibility for Medicare and for such other purposes as may be deemed appropriate.
The proper officers of the Borough of Churchill are directed to establish a bank account, with said account to be known as the "Borough of Churchill Welfare Benefit Plan" account of the Borough of Churchill and to deposit in said account all moneys received from the transfer of the inadvertent contributions from the pension plan(s) as previously set forth and such other donations and contributions as may be made, from time to time, and to administer the same.
A. 
The proper officers of the borough shall be permitted to accept any additional donations as may be given by any member or former member of the Churchill Borough Police Department or by the Borough of Churchill or its employees, or other interested individuals.
B. 
The borough, notwithstanding its obligations under the statutes of the Commonwealth of Pennsylvania or its Police Pension Ordinance,[1] shall make such additional contributions or donations as it may deem, in its sole discretion, to be necessary and proper to carry out the purposes of the plan.

The proper officers of the Borough of Churchill are hereby further authorized to enter into any agreement with the Borough Police of Churchill Borough or borough employees with regard to this Welfare Benefit Plan to the extent their participation may hereinafter be necessary to effectuate any term, condition or requirement.
The Borough of Churchill Welfare Benefit Plan shall be effective as of January 1, 1991, and is to apply to only those members or employees retiring after said date.
