A Municipal Court for the City of North Wildwood, in the County of Cape May, is established as of January 1, 1949, pursuant to the provisions of Chapter 264 of the Laws of 1948, as amended and supplemented.[1]

The name of the Municipal Court shall be the "Municipal Court of the City of North Wildwood, in the County of Cape May."
The Municipal Court shall have a seal which shall bear the impress of the name of the Court.

There shall be a Municipal Judge of the said Municipal Court, who shall be appointed by the Mayor with the advice and consent of Council, and who shall serve for a term of three years from the date of his appointment and until his successor is appointed and qualified.

The Municipal Judge shall receive an annual salary as determined from time to time by the Mayor and City Council, to be paid in the same manner as the salaries of other municipal officers are paid, and which shall be in lieu of all fees, costs and any other allowances whatsoever.

The said Municipal Court and the Municipal Judge thereof shall have, possess and exercise all the functions, powers, duties and jurisdictions conferred by the provisions of N.J.S.A. 2B:12-1 et seq., as amended and supplemented, and by any other applicable laws.
The governing body may by ordinance or resolution at any time provide for a Clerk or other necessary assistants for said Municipal Court and provide for their compensation. The governing body may likewise designate by ordinance or resolution any officer or employee of the municipality to serve as Clerk of the Municipal Court with or without additional compensation.

The Municipal Court shall be held in the City of North Wildwood Municipal Court located at 901 Atlantic Avenue in the City of North Wildwood. The Municipal Judge shall sit on such dates and at such times as annually established by the Municipal Judge and shall continue to sit until the calendar is completed, and at such other times as the business of the Court may require, subject to the rules applicable to municipal courts.

A. 
The City of North Wildwood shall have at least one Public Defender for its Municipal Court, appointed by the governing body for a term of one year, and until the appointment of a successor. In the event two or more Public Defenders are appointed, one of them shall be designated "Chief Municipal Public Defender."
B. 
Applications for the Public Defender.
(1) 
An indigent defendant applying for representation by a Municipal Public Defender in the City of North Wildwood shall pay an application fee of $200.
(2) 
The Municipal Court Judge may waive the required application fee, in whole or in part, if the Judge determines, in his or her discretion, that the application fee represents an unreasonable burden on the person seeking representation.
