The placing, depositing, collection and disposition of solid waste within the City limits of the City of North Wildwood, New Jersey, shall not be permitted in any manner whatsoever, except as provided for herein.
For the purpose of this article, the following shall serve to define the subject matter hereof:
COMPUTERS AND CONSUMER ELECTRONICS
Includes a computer central processing unit and associated hardware, including keyboards, modems, printers, scanners and fax machines, cathode ray tubes, cathode ray tube devices, flat panel displays or similar video display devices with a screen that is greater than four inches measured diagonally and that contains one or more circuit boards, including, but not limited to, televisions and cell phones. Also includes VCRs, radios and landline telephones.

CONSTRUCTION DEBRIS
Any and all materials arising out of the erection, alteration, demolition or refurbishing of buildings and/or structures.
GARBAGE
Animal and vegetable matter that has been used as food, or was intended to be used for food, and the waste therefrom; and dead animals or fish or parts of same, also including food condemned by the Board of Health.
SOLID WASTE
Includes all garbage, trash and other discarded materials resulting from commercial, domestic and community activities. Items shall include, but not be limited to, grass cuttings, hedge trimmings, weeds and household appliances.
TRASH
Any and all household and business debris, refuse and castoffs, including discarded furniture, appliances and other large items not particularly described as garbage, but said definition does not include the trash and debris arising out of the erection, alteration, demolition or refurbishing of buildings or structures.
WHITE GOODS
Includes household appliances such as clothes washers, clothes dryers, household refrigerators and household freezers (including household appliances containing chlorofluorocarbon [CFC] and Freon).

A. 
Every person, householder, owner, occupant or proprietor of a hotel, motel, restaurant, boardinghouse, market, store, mercantile establishment or other place of habitation or commercial or residential operation shall provide, or cause to be provided, suitable receptacles for garbage and trash, which receptacles shall be rigid in construction and have a snug-fitting top and shall be placed at the location most convenient for collections, with said location to be fixed by the Chairman of the Public Safety Committee.
B. 
The receptacles for garbage and trash shall be of rigid construction, have a snug-fitting top, be watertight and have suitable handles. The capacity shall not be less than four gallons nor more than 32 gallons, nor more than 50 pounds in weight when filled to capacity. A suitable number of such receptacles shall be provided by every owner, occupant or proprietor at each location. The receptacles shall be kept clean, and no rainwater or other liquid shall be allowed to enter the same. In addition, the garbage and trash may be further enclosed in a disposable bag.
C. 
The owner or occupant of the premises shall keep all receptacles clean and in safe handling condition. Receptacles or other items to be recycled shall be placed out for collection any time after 5:00 p.m. of the day immediately preceding the day of collection, but no later than 7:00 a.m. of the day of collection. After collection, any containers shall be removed from the curbside by no later than 7:00 p.m. of the day of collection.

All materials and rubbish, such as wood, cartons, etc., too large to be placed in containers shall be placed at the curbside in an orderly manner by the owner for pickup. Such materials shall be broken up or separated and tied or secured so that individual sections or bundles shall not exceed a normal lifting weight of 50 pounds.

A. 
The disposal of all construction debris shall be the responsibility of the owner and/or contractor creating same, and they shall be responsible for making their own arrangements with a private contractor for its prompt removal (all in accordance with the International Building and Residential Codes, New Jersey Edition). Owners of real property in the City of North Wildwood shall be permitted to place out for collection carpet, from one room only, not exceeding 225 square feet on any one collection day. The carpet shall be cut into widths of no more than 5 feet and rolled and tied or taped for ease of collection. It shall be the responsibility of the owner of the premises to make arrangements for the removal of any additional carpet with a private contractor.
B. 
Each owner of real property in the City of North Wildwood shall be permitted to place out for collection one bulk item, such as furniture, on each collection day. The combination of a box spring and mattress shall count as one bulk item.
Owners and operators of apartment houses, motels, hotels and other housing combinations having more than two living units shall furnish community receptacles for garbage and trash, into which tenants may empty their receptacles used for each apartment, unit or room.

Every householder, owner, occupant or proprietor of a hotel, motel, restaurant, boarding place, market, store or other place of commercial operation will be entitled to the regular collection of garbage and trash either one or two times each week, depending on the time of year and the schedule for solid waste collection contained in the current solid waste collection contract, and there shall be at least 72 hours between collections at each collection point. Any person or establishment requiring additional collection or desirous of obtaining same on a daily basis, or whose collections exceed 10 receptacles or their equivalent at any one collection, shall be responsible for making their own arrangements with a private contractor for the collection of same.
It shall be unlawful for anyone to abuse the privilege of using large trash and garbage containers provided in the city, which are placed at various locations throughout the city, by dropping or depositing commercial waste or construction material therein.
This article is deemed necessary in the interest of the public health of the inhabitants of the City of North Wildwood.

Every household, owner, occupant or business proprietor who wishes to have the City of North Wildwood's trash contractor remove any white goods and computers and consumer electronics shall be required to pay a fee in the amount of $20 per item to the City of North Wildwood. Said fee must be paid to the City of North Wildwood through the City Clerk's office prior to the items being removed by the contractor.

Every household, owner, occupant or business proprietor who wishes to have the trash contractor of the City of North Wildwood and/or the Public Works Department of the City of North Wildwood remove any tires shall be required to pay a fee in the amount of $5 per tire to the City of North Wildwood. Said fee must be paid to the City of North Wildwood, to the City Clerk's Office, prior to the tires being removed by the contractor and/or the city.

Any person, firm, association or corporation violating any section of this article shall, upon conviction before the Municipal Court of the City of North Wildwood, be subject to a fine of not more than $1,250 or imprisonment in the county jail for a term of not more than 90 days, or both. Any repetition of any violation of this article shall be deemed a new offense.
