Upon enactment of this article, no gas- or electric-powered motorized
scooter shall be permitted to drive on any Borough Roadway.
This article shall not affect nor is it intended to affect the use of
any vehicle that is foot-powered such as bicycle, tricycle, or similar vehicle,
from operating safely. and in accordance with the law, on any public roadway
owned or maintained by the Borough of East Rutherford.
Notwithstanding any other provision of law, any driver of or passenger
on such motorized scooter that traverses a Borough road shall be required
to wear a helmet if they would be required to wear a helmet if they were operating
a bicycle, or driving a motorcycle.
