As used in this article, the following terms shall have the meanings indicated:
MECHANICAL FOOD VENDING MACHINE
Any automatic vending machine used for the storage or sale of food or drink and operated and controlled by the insertion of a coin or coins.
No mechanical food vending machine shall be maintained for operation within the Borough of East Rutherford unless a license for such operation has been issued therefor by the borough upon application and the payment of the required license fee. Application for such license shall be made to the Borough Clerk upon a form to be supplied by the Borough Clerk for that purpose. The application for a license shall contain the following information:
A. 
Name and address of the applicant.
B. 
Location where the machine is to be maintained for operation.
C. 
Description of the machine to be covered by the license, including name of manufacturer and serial number, if any.
D. 
The name, address and telephone number of the person responsible for the operation, maintenance and servicing of the machine.

Every license issued pursuant to this article shall expire on the last day of December of the year during which the license is issued. Every applicant, before being granted a license, shall pay a license fee of $15 for maintaining each mechanical food vending machine.
No mechanical food vending machine shall be maintained for operation in the Borough of East Rutherford unless it complies with each of the following requirements:
A. 
The machine shall meet all pertinent requirements and regulations of the Board of Health of the borough and be approved upon any inspection made pursuant to such regulations.
B. 
If the food or drink dispensed by the machine is subject to spoilage, the machine shall be equipped with a refrigeration unit to maintain the contents at a temperature low enough to preserve the contents in a healthful condition at all times and shall also be equipped with an automatic device which will prevent the machine from dispensing any of its contents when the temperature thereof rises above such point.
C. 
If the food or drink dispensed by the machine is represented to be heated, the machine shall be equipped with a device to maintain the temperature at an appropriate degree and shall also be equipped with an automatic device which will prevent the machine from dispensing any of its contents when the temperature of the drink or food falls below such appropriate degree.
D. 
The machine shall be properly labeled so as to identify the kind, type and grade of product dispensed from any opening as well as the producer of each such product.
E. 
The machine shall contain on the front thereof and in a conspicuous place and manner the name, address and telephone number of the person who is responsible for the operation, maintenance and servicing of the machine.[1]
