It shall be unlawful for any minor person under the age of 18 years to be or remain in or upon any of the streets, parks or public places in the Township of Brighton between the hours of 11:00 p.m to 6:00 a.m., prevailing time, unless such person is accompanied by a parent, guardian or other person having the legal custody of such person.
It is hereby made unlawful for any parent, guardian or other person having the legal care or custody of any minor person under the age of 18 years to allow or permit any such minor person to go or be in or upon any of the streets, alleys, parks or other public places in the Township of Brighton between the hours specified in § 88-1 of this chapter, except as therein provided.
Any minor person under the age of 18 years found upon the streets, alleys, parks or public places in the Township of Brighton, in violation of § 88-1 of this chapter shall be taken into custody by the township police and delivered by the township police to the parents, guardian or person having the legal custody of such minor person. The apprehending police officer shall immediately make a report thereof in a book to be kept for that purpose in the office of the township police. If such minor person shall again be found in or upon any of the streets, alleys, parks or public places in the Township of Brighton in violation of § 88-1 of this chapter, he shall then be prosecuted before the District Justice having jurisdiction.
Any person who shall violate any of the provisions of this chapter shall, upon conviction before the District Justice, be sentenced to pay a fine of $100 for the first offense. For each subsequent violation by any person, that person, upon conviction before the District Justice, shall be sentenced to pay a fine of not less than $150 nor more than $300. In the event the fine and costs of prosecution are not paid within the time prescribed by the District Justice, the District Justice may sentence the defendant to perform a maximum of 10 hours of community service for the first offense and a maximum of 25 hours of community service for each subsequent offense.
